Duke pasur parasysh k\u00ebto mang\u00ebsi, ka shum\u00eb rrezik q\u00eb GPN t\u00eb d\u00ebshtoj\u00eb n\u00eb zhvillimin e nj\u00eb strategjie komb\u00ebtare q\u00eb ka kredibilitet dhe legjitimitet p\u00ebr t\u00eb avancuar transformimin shoq\u00ebror.<br \/>\n&#8211; Me q\u00ebllim q\u00eb t\u00eb nxjerr\u00eb nj\u00eb Strategji Komb\u00ebtare kuptimplot\u00eb, Qeveria e Kosov\u00ebs duhet t\u00eb zotohet politikisht p\u00ebr procesin e GPN-s\u00eb, t\u00eb nd\u00ebrtoj\u00eb besimin me p\u00ebrfaq\u00ebsues t\u00eb shoq\u00ebris\u00eb civile dhe t\u00eb komuniteteve pakic\u00eb, t\u00eb planifikoj\u00eb p\u00ebr konsultime gjith\u00ebp\u00ebrfshir\u00ebse komb\u00ebtare, dhe t\u00eb nd\u00ebrlidh\u00eb pun\u00ebn e GPN-s\u00eb me proceset e tjera q\u00eb lidhen me drejt\u00ebsin\u00eb tranzicionale n\u00eb Kosov\u00eb, duke p\u00ebrfshir\u00eb edhe nj\u00eb Komision t\u00eb ri p\u00ebr t\u00eb V\u00ebrtet\u00ebn dhe Pajtimin.<br \/>\n&#8211; Shoq\u00ebria civile duhet t\u00eb p\u00ebrvet\u00ebsoj\u00eb nj\u00eb qasje m\u00eb strategjike ndaj drejt\u00ebsis\u00eb tranzicionale dhe ta forcoj\u00eb ekspertiz\u00ebn rreth nd\u00ebrveprimit me proceset politike, nd\u00ebrsa bashk\u00ebsia nd\u00ebrkomb\u00ebtare duhet t\u00eb ofroj\u00eb m\u00eb shum\u00eb mb\u00ebshtetje politike p\u00ebr pun\u00ebn e GPN-s\u00eb, t\u00eb p\u00ebrmir\u00ebsoj\u00eb bashk\u00ebrendimin p\u00ebr drejt\u00ebsin\u00eb tranzicionale dhe ta integroj\u00eb drejt\u00ebsin\u00eb tranzicionale si pjes\u00eb t\u00eb procesit t\u00eb p\u00ebrafrimit n\u00eb Bashkimin Evropian (BE).<\/p>\n<p style=\"text-align: justify;\">Mir\u00ebnjohje<\/p>\n<p style=\"text-align: justify;\">Kjo pun\u00eb nuk do t\u00eb ishte e mundur pa pjes\u00ebmarrjen e nj\u00eb game t\u00eb gjer\u00eb aktivist\u00ebsh t\u00eb shoq\u00ebris\u00eb civile, zyrtar\u00ebsh publik\u00eb dhe t\u00eb tjer\u00ebve t\u00eb p\u00ebrfshir\u00eb n\u00eb fush\u00ebn e drejt\u00ebsis\u00eb transizionale dhe t\u00eb ballafaqimit me t\u00eb kaluar\u00ebn n\u00eb Kosov\u00eb. Hyrje<\/p>\n<p style=\"text-align: justify;\">N\u00eb qershor t\u00eb vitit 2012, Qeveria e Kosov\u00ebs (QK) themeloi Grupin Punues Nd\u00ebrministror p\u00ebr Ballafaqim me t\u00eb Kaluar\u00ebn dhe Pajtim (m\u00eb tutje GPN) p\u00ebr t\u2019u &#8220;<a href=\"http:\/\/www.recom.link\/wp-content\/uploads\/2012\/06\/Decision-on-the-establishment-of-Inter-Ministerial-Working-Group-on-Dealing-with-the-Past-and-Reconciliation1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">marr\u00eb me shkelje t\u00eb r\u00ebnda t\u00eb t\u00eb drejtave t\u00eb njeriut dhe shkelje t\u00eb r\u00ebnda t\u00eb t\u00eb drejt\u00ebs humanitare nd\u00ebrkomb\u00ebtare n\u00eb t\u00eb kaluar\u00ebn n\u00eb Kosov\u00eb, duke p\u00ebrfshir\u00eb edhe luft\u00ebn e fundit dhe periudh\u00ebn e tranzicionit<\/a>1&#8243;. E ndodhur brenda Zyr\u00ebs s\u00eb Kryeministrit, GPN-ja kishte p\u00ebr q\u00ebllim t\u00eb sh\u00ebrbente si pik\u00eb qendrore brenda QK p\u00ebr leht\u00ebsimin e nj\u00eb procesi gjith\u00ebp\u00ebrfshir\u00ebs dhe me ndjeshm\u00ebri gjinore p\u00ebr ballafaqim me t\u00eb kaluar\u00ebn (BmK) p\u00ebrmes dialogut dhe bashk\u00ebpunimit, duke nxjerr\u00eb n\u00eb fund nj\u00eb Strategji Komb\u00ebtare p\u00ebr Drejt\u00ebsin\u00eb Tranzicionale.<br \/>\nKrijimi i GPN e p\u00ebrfaq\u00ebsonte iniciativ\u00ebn e par\u00eb dometh\u00ebn\u00ebse t\u00eb QK q\u00eb synonte trajtimin e \u00e7\u00ebshtjeve t\u00eb BmK dhe t\u00eb pajtimit. Ai krijoi baz\u00ebn p\u00ebr p\u00ebrmbushjen e detyrimeve t\u00eb Kosov\u00ebs lidhur me zbatimin e Propozimit Gjith\u00ebp\u00ebrfshir\u00ebs p\u00ebr Statusin (PGjS), t\u00eb njohur m\u00eb mir\u00eb p\u00ebr publikun si Plani i Ahtisaarit, i cili mb\u00ebshteti shpalljen e pavar\u00ebsis\u00eb s\u00eb Kosov\u00ebs m\u00eb 2008. PGjS-ja p\u00ebrmban dispozita q\u00eb synojn\u00eb t\u00eb promovojn\u00eb dhe t\u2019i mbrojn\u00eb t\u00eb drejtat e njeriut dhe t\u00eb komuniteteve, dhe parashikon krijimin e nj\u00eb procesi p\u00ebr BmK dhe drejt\u00ebsin\u00eb tranzicionale.<br \/>\nGPN u mandatua p\u00ebr t\u00eb nxitur nj\u00eb proces t\u00eb pajtimit mes t\u00eb gjitha komuniteteve dhe pjes\u00ebtar\u00ebve t\u00eb tyre n\u00eb Kosov\u00eb. Ajo ishte e autorizuar p\u00ebr t\u00eb ofruar rekomandime dhe mendime k\u00ebshilldh\u00ebn\u00ebse p\u00ebr ministrit\u00eb, institucionet e tjera publike, komunitetet n\u00eb nivel lokal dhe qytetar\u00ebt. \u00c7&#8217;\u00ebsht\u00eb m\u00eb e r\u00ebnd\u00ebsishmja, kjo pun\u00eb synonte t\u00eb i marr\u00eb parasysh pik\u00ebpamjet e t\u00eb gjitha komuniteteve n\u00eb Kosov\u00eb, me q\u00ebllim q\u00eb t\u00eb promovonte pajtimin dhe paqen e q\u00ebndrueshme, si dhe t\u00eb siguronte llogaridh\u00ebnie, t\u2019i sh\u00ebrbente drejt\u00ebsis\u00eb, t\u2019i ofronte mjete viktimave, t\u00eb leht\u00ebsonte k\u00ebrkimin e t\u00eb v\u00ebrtet\u00ebs, t\u00eb promovonte sh\u00ebrimin dhe t\u00eb merrte masat e nevojshme p\u00ebr t\u00eb kthyer besimin n\u00eb institucionet e shtetit, n\u00eb p\u00ebrputhje me t\u00eb drejt\u00ebn nd\u00ebrkomb\u00ebtare p\u00ebr t\u00eb drejtat e njeriut dhe standardet e drejt\u00ebsis\u00eb tranzicionale.<br \/>\nP\u00ebrfaq\u00ebsuesit e 12 institucioneve publike dhe tet\u00eb organizatave t\u00eb shoq\u00ebris\u00eb civile (OShC) u em\u00ebruan n\u00eb GPN, duke p\u00ebrfshir\u00eb edhe agjencit\u00eb publike, organizatat nd\u00ebrkomb\u00ebtare dhe misionet diplomatike me rol k\u00ebshilldh\u00ebn\u00ebs. N\u00ebngrupet u organizuan rreth kat\u00ebr shtyllave t\u00eb drejt\u00ebsis\u00eb tranzicionale: (1) k\u00ebrkimit t\u00eb s\u00eb v\u00ebrtet\u00ebs, (2) reparacioneve, (3) drejt\u00ebsis\u00eb dhe (4) reformave institucionale.<br \/>\nN\u00eb pes\u00eb vitet q\u00eb nga themelimi, GPN nuk ia ka dal\u00eb t\u2019i arrij\u00eb objektivat e veta, ve\u00e7mas n\u00eb lidhje me nxjerrjen e nj\u00eb Strategjie Komb\u00ebtare. Kundrejt k\u00ebtij sfondi, dy OShC kosovare (Integra dhe Qendra p\u00ebr Paqe dhe Toleranc\u00eb) dhe dy OShC nd\u00ebrkomb\u00ebtare (Impunity Watch dhe PAX) nis\u00ebn nj\u00eb shqyrtim objektiv, sistematik dhe t\u00eb pavarur nga ana e shoq\u00ebris\u00eb civile rreth pun\u00ebs s\u00eb GPN-s\u00eb, dhe nj\u00eb proces reflektimi kolektiv mbi implikimet e k\u00ebsaj pune p\u00ebr besueshm\u00ebrin\u00eb dhe legjitimitetin e Strategjis\u00eb Komb\u00ebtare dhe perspektivat e saj p\u00ebr avancimin e transformimit shoq\u00ebror. Dy konsulent\u00eb jan\u00eb ngarkuar p\u00ebr realizimin e k\u00ebtij shqyrtimi dhe ky raport \u00ebsht\u00eb rezultat i k\u00ebtij procesi.<\/p>\n<p style=\"text-align: justify;\">2. Metodologjia<\/p>\n<p style=\"text-align: justify;\">Gjetjet dhe rekomandimet n\u00eb k\u00ebt\u00eb raport bazohen kryesisht n\u00eb intervista me nj\u00eb gam\u00eb t\u00eb gjer\u00eb pal\u00ebsh t\u00eb interesit n\u00eb Kosov\u00eb, duke paraqitur nj\u00eb vler\u00ebsim objektiv se ku q\u00ebndron procesi. \u00cbsht\u00eb e r\u00ebnd\u00ebsishme t\u00eb theksohet se bashkautor\u00ebt nuk ia dol\u00ebn ta intervistonin kryetarin e GPN-s\u00eb, pavar\u00ebsisht k\u00ebrkesave specifike, dhe nuk ia dol\u00ebn t\u00eb siguronin disa dokumente q\u00eb thuhet t\u2019i ket\u00eb nxjerr\u00eb GPN-ja. Duke pasur parasysh se objektivi qendror I k\u00ebtij rishikimi nga ana e shoq\u00ebris\u00eb civile ishte q\u00eb t\u00eb vler\u00ebsohej aft\u00ebsia e GPN-s\u00eb p\u00ebr t\u00eb hartuar Strategjin\u00eb Komb\u00ebtare, bashkautor\u00ebt e konsideruan t\u00eb r\u00ebnd\u00ebsishme ta shqyrtonin kontekstin politik, dhe prandaj fol\u00ebn me shum\u00eb njer\u00ebz q\u00eb nuk lidhen direkt me GPN-n\u00eb por posedojn\u00eb njohuri specifike n\u00eb mjedisin e gjer\u00eb t\u00eb BmK.<br \/>\nGithsej 32 intervista t\u00eb detajuara dhe 25 takime takime p\u00ebr shqyrtim multidisiplinor jan\u00eb kryer nga bashkautor\u00ebt n\u00eb periudh\u00ebn 9-18 janar 2017 n\u00eb Prishtin\u00eb. Intervistat synonin t\u00eb shqyrtonin perspektivat e t\u00eb anketuarve mbi pun\u00ebn e GPN p\u00ebrmes nj\u00eb s\u00ebr\u00eb pyetjesh t\u00eb gjysm\u00ebstrukturuara. Pyetje plot\u00ebsuese u b\u00ebn\u00eb gjat\u00eb intervistave p\u00ebr t\u00eb sqaruar dhe\/ose p\u00ebr t\u2019u zgjeruar m\u00eb tej n\u00eb \u00e7\u00ebshtje t\u00eb caktuara q\u00eb lidhen me drejt\u00ebsin\u00eb tranzicionale n\u00eb Kosov\u00eb. Prej t\u00eb intervistuarve, 14 ishin an\u00ebtar\u00eb aktiv\u00eb t\u00eb GPN-s\u00eb ose i p\u00ebrkisnin OShC; ata p\u00ebrfshinin njer\u00ebz q\u00eb p\u00ebrfaq\u00ebsojn\u00eb komunitetet pakic\u00eb, ministrit\u00eb dhe agjencit\u00eb publike, nj\u00eb ish-kryesues t\u00eb GPN-s\u00eb, v\u00ebzhgues nga aktor\u00ebt kryesor\u00eb nd\u00ebrkomb\u00ebtar\u00eb n\u00eb Kosov\u00eb n\u00eb fush\u00ebn e BmK, si dhe nj\u00eb k\u00ebshilltar teknik t\u00eb huaj.<br \/>\nN\u00eb rastin e tre t\u00eb anketuarve q\u00eb nuk ishin t\u00eb pranish\u00ebm n\u00eb Prishtin\u00eb, u zhvilluan intervista me Skype. Dy pjes\u00ebtar\u00eb t\u00eb GPN-s\u00eb q\u00eb p\u00ebrfaq\u00ebsojn\u00eb komunitetet pakic\u00eb dhe disa p\u00ebrfaq\u00ebsues t\u00eb ministrive dhe t\u00eb OShC mor\u00ebn pyetje t\u00eb gjysm\u00ebstrukturuara dhe i dor\u00ebzuan p\u00ebrgjigjet e tyre me shkrim.<br \/>\nIntervistat jan\u00eb regjistruar n\u00eb m\u00ebnyr\u00eb dixhitale, jan\u00eb transkriptuar, dhe jan\u00eb rishikuar nga bashkautor\u00ebt. Jan\u00eb marr\u00eb edhe sh\u00ebnime. Raporti i k\u00ebtij rishikimi iu \u00ebsht\u00eb dor\u00ebzuar p\u00ebr validim p\u00ebrfaq\u00ebsuesve t\u00eb OShC-ve n\u00eb Kosov\u00eb q\u00eb jan\u00eb aktive n\u00eb fush\u00ebn e BmK. Procesi i validimit konfirmoi analiz\u00ebn dhe konstatimet e raportit.<\/p>\n<p style=\"text-align: justify;\">3. Gjetjet<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201c&#8230; procesi \u00ebsht\u00eb tejet i r\u00ebnd\u00ebsish\u00ebm p\u00ebr marr\u00ebdh\u00ebniet e ardhshme nd\u00ebretnike. Bashk\u00ebjetesa dhe pajtimi jan\u00eb t\u00eb pamundshme pa drejt\u00ebsi tranzicionale\u201d. (i anketuar me etni serbe)<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">3.1. A I ka arritur GPN objektivitat?<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">Sipas mandatit t\u00eb GPN, detyra kryesore e tij ishte:<br \/>\n\u201ct\u00eb vendos\u00eb nj\u00eb qasje gjith\u00ebp\u00ebrfshir\u00ebse dhe me ndjeshm\u00ebri gjinore p\u00ebr ballafaqimin me t\u00eb kaluar\u00ebn n\u00eb Kosov\u00eb, duke p\u00ebrfshir\u00eb edhe luft\u00ebn e fundit dhe periudh\u00ebn e tranzicionit, duke marr\u00eb parasysh pik\u00ebpamjet e viktimave t\u00eb t\u00eb gjitha komuniteteve n\u00eb Kosov\u00eb, p\u00ebr ta arritur nj\u00eb Strategji Komb\u00ebtare t\u00eb Drejt\u00ebsis\u00eb Tranzicionale&#8221;.<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Shqyrtimi nga shoq\u00ebria civile qartazi tregon se GPN nuk i ka p\u00ebrmbushur pritshm\u00ebrit\u00eb. Pes\u00eb vjet q\u00eb nga themelimi i grupit t\u00eb pun\u00ebs, nuk \u00ebsht\u00eb miratuar asnj\u00eb Strategji Komb\u00ebtare; n\u00eb t\u00eb v\u00ebrtet\u00eb, sipas informatave n\u00eb dispozicion, asnj\u00eb draft nuk \u00ebsht\u00eb qarkulluar mes an\u00ebtar\u00ebve p\u00ebr diskutim. Nj\u00eb plan i detajuar p\u00ebr konsultime nacionale n\u00eb BmK \u00ebsht\u00eb zhvilluar nga nj\u00eb grup i vog\u00ebl an\u00ebtar\u00ebsh t\u00eb GPN n\u00eb n\u00ebntor t\u00eb vitit 20162. Ky plan besohet t\u00eb jet\u00eb me kryesuesin e GPN-s\u00eb, por asnj\u00eb informacion nuk \u00ebsht\u00eb dh\u00ebn\u00eb se \u00e7\u2019hapa t\u00eb m\u00ebtejm\u00eb parashikohen p\u00ebr kryerjen e konsultimeve.<br \/>\nMandati i GPN-s\u00eb bazohet n\u00eb nj\u00eb vendim zyrtar t\u00eb qeveris\u00eb, i marr\u00eb n\u00eb p\u00ebrputhje me Korniz\u00ebn Kushtetuese t\u00eb Kosov\u00ebs. Ky ishte sinjal i qart\u00eb se BmK \u00ebsht\u00eb \u00e7\u00ebshtje e r\u00ebnd\u00ebsishme p\u00ebr shtetin. Prandaj p\u00ebrgjegj\u00ebsia p\u00ebr suksesin ose d\u00ebshtimin e procesit t\u00eb GPN-s\u00eb n\u00eb fund t\u00eb fundit i faturohet QK.<\/p>\n<p style=\"text-align: justify;\">3.2.Me \u00e7far\u00eb sfidash u p\u00ebrball GPN?<\/p>\n<p style=\"text-align: justify;\">Intervistat shpalos\u00ebn arsye t\u00eb ndryshme p\u00ebr d\u00ebshtimin e GPN-s\u00eb q\u00eb t\u00eb zhvilloj\u00eb nj\u00eb Strategji Komb\u00ebtare. K\u00ebto p\u00ebrfshijn\u00eb probleme procedurale si dhe substanciale.<br \/>\nProblemet procedurale<br \/>\n&#8211; Planifikimi dhe dizajni: Disa t\u00eb anketuar ngrit\u00ebn shqet\u00ebsimin se mandati i GPN-s\u00eb ishte tejet i gjer\u00eb dhe tep\u00ebr ambicioz. GPN \u00ebsht\u00eb dizajnuar kryesisht nga p\u00ebrfaq\u00ebsues t\u00eb komunitetit nd\u00ebrkomb\u00ebtar dhe t\u00eb QK, dhe nuk jan\u00eb mbajtur konsultime me OShC-t\u00eb para se ai t\u00eb krijohej. Shoqatat e viktimave dhe t\u00eb personave t\u00eb zhdukur ishin kryesisht t\u00eb painformuara lidhur me GPN-n\u00eb dhe pun\u00ebn e tij.<br \/>\n&#8211; Udh\u00ebheq\u00ebsia dhe menaxhimi: Disa t\u00eb anketuar n\u00ebnvizuan se GPN-s\u00eb i mungonte udh\u00ebheq\u00ebsia e fort\u00eb dhe e q\u00ebndrueshme, se stili i kryesimit t\u00eb takimeve ishte autoritar dhe se vendimet jo gjithmon\u00eb pasqyronin rezultatet e diskutimeve. Udh\u00ebheq\u00ebsia dhe menaxhimi m\u00eb efektiv, duke p\u00ebrfshir\u00eb edhe sekretariatin e GPN-s\u00eb, mund t\u00eb ken\u00eb ndihmuar p\u00ebr t\u2019i kap\u00ebrcyer disa nga problemet e identifikuara n\u00eb k\u00ebt\u00eb shqyrtim.<br \/>\n&#8211; Shum\u00eb t\u00eb anketuar (kryesisht nga OShC-t\u00eb) shpreh\u00ebn shqet\u00ebsimin se mungesa e kapaciteteve t\u00eb an\u00ebtar\u00ebve t\u00eb GPN-s\u00eb dhe shp\u00ebrpjestimi n\u00eb k\u00ebt\u00eb drejtim mes p\u00ebrfaq\u00ebsuesve t\u00eb OShC-ve dhe atyre t\u00eb ministrive kan\u00eb kontribuar n\u00eb vendimmarrje t\u00eb dob\u00ebt. Edhe pse shum\u00eb an\u00ebtar\u00eb t\u00eb OShC-ve kan\u00eb p\u00ebrvoj\u00eb dhe ekspertiz\u00eb n\u00eb fush\u00ebn e BmK, u mungon p\u00ebrvoja p\u00ebr m\u00ebnyr\u00ebn se si punojn\u00eb institucionet dhe p\u00ebr procesin e hartimit t\u00eb strategjive. Megjithat\u00eb, krijimi i n\u00ebngrupeve i b\u00ebri an\u00ebtar\u00ebt m\u00eb aktiv\u00eb e produktiv\u00eb, dhe u prodhuan disa draft-dokumente. P\u00ebrfaq\u00ebsuesit nga ministrit\u00eb nuk kishin pozita t\u00eb larta dhe nuk kishin fuqi vendimarr\u00ebse, dhe nuk mund t\u00eb flisnin n\u00eb em\u00ebr t\u00eb institucioneve t\u00eb veta; kishte munges\u00eb komunikimi mes k\u00ebtyre p\u00ebrfaq\u00ebsuesve dhe epror\u00ebve t\u00eb tyre. Mungesa e unitetit dhe bashk\u00ebpunimit mes an\u00ebtar\u00ebve n\u00eb seanca plenare pengonte pun\u00ebn e GPN-s\u00eb. Tensionet e brendshme dhe mosmarr\u00ebveshjet (p\u00ebrfshir\u00eb ato mes kryesuesit dhe p\u00ebrfaq\u00ebsuesve t\u00eb shoq\u00ebris\u00eb civile) ishin jo t\u00eb rralla.<br \/>\n&#8211; Mungesa e burimeve t\u00eb ndara financiare e njer\u00ebzore: QK mb\u00ebshtetej t\u00ebr\u00ebsisht n\u00eb donator\u00ebt nd\u00ebrkomb\u00ebtar\u00eb p\u00ebr t\u00eb mbuluar shpenzimet lidhur me procesin, pa ndar\u00eb ndonj\u00eb burim t\u00eb brendsh\u00ebm financiar a njer\u00ebzor. Financimi nga donator\u00ebt mbulonte shpenzimet baz\u00eb, por jo zbatimin e aktiviteteve.<br \/>\n&#8211; Parregullsia e takimeve: Takimet e GPN-s\u00eb ishin t\u00eb rralla, nd\u00ebrsa n\u00eb baz\u00eb t\u00eb rregullave t\u00eb GPN duhej t\u00eb kishte takime mujore3.<br \/>\n&#8211; Ngadal\u00ebsia e procesit: GPN ende pritet t\u00eb miratoj\u00eb nj\u00eb plan veprimi, pavar\u00ebsisht detyrimit p\u00ebr ta b\u00ebr\u00eb k\u00ebt\u00eb brenda 10 muajve nga data e themelimit.<br \/>\n&#8211; Mungesa e qasjes objektive dhe e komunikimit \u00ebsht\u00eb identifikuar nga disa t\u00eb anketuar si nj\u00eb faktor q\u00eb ndaloi GPN-n\u00eb nga p\u00ebrfshirja kuptimplot\u00eb e publikut t\u00eb gjer\u00eb.<br \/>\n&#8211; Mungesa e mbik\u00ebqyrjes parlamentare: P\u00ebr shembull, Komisioni i Kuvendit t\u00eb Kosov\u00ebs p\u00ebr t\u00eb Drejtat e Njeriut, Persona t\u00eb Pagjetur dhe Peticione nuk u ftua p\u00ebr t&#8217;u p\u00ebrfshir\u00eb n\u00eb pun\u00ebn e GPN-s\u00eb.<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cN\u00eb asnj\u00eb faz\u00eb nuk kishte ndonj\u00eb p\u00ebrfshirje nga parlamenti n\u00eb pun\u00ebn e grupit t\u00eb pun\u00ebs, pavar\u00ebsisht faktit se Komisioni i at\u00ebhersh\u00ebm parlamentar p\u00ebr t\u00eb Drejtat e Njeriut merrej me \u00e7\u00ebshtje t\u00eb drejt\u00ebsis\u00eb tranzicionale, si personat e zhdukur\u201d. (i anketuar me etni shqiptare)<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Asistenca teknike e ofruar nga bashk\u00ebsia nd\u00ebrkomb\u00ebtare mund t\u00eb ishte m\u00eb efektive n\u00eb mb\u00ebshtetjen dhe monitorimin e procesit n\u00ebse ajo do ta lunate nj\u00eb rol m\u00eb proaktiv n\u00eb k\u00ebshillimin e grupit p\u00ebr \u00e7\u00ebshtje procedurale. Megjithat\u00eb, kjo ndihm\u00eb ka mb\u00ebshtetur pun\u00ebn n\u00eb n\u00ebngrupet, dhe nj\u00eb pasqyr\u00eb m\u00eb pozitive u prezantua nga t\u00eb anketuarit lidhur me pun\u00ebn n\u00eb t\u00eb pakt\u00ebn disa nga to, si n\u00ebngrupi p\u00ebr d\u00ebmshp\u00ebrblime.<br \/>\nProblemet thelb\u00ebsore<br \/>\nProcesi i k\u00ebtij shqyrtimi ka identifikuar nj\u00eb s\u00ebr\u00eb \u00e7\u00ebshtjesh thelb\u00ebsore q\u00eb pengonin hartimin e nj\u00eb Strategjie Komb\u00ebtare p\u00ebr Drejt\u00ebsin\u00eb Tranzicionale. K\u00ebto mund t\u00eb grupohen n\u00eb tri kategori: (1) dinamika brenda GPN-s\u00eb, (2) marr\u00ebdh\u00ebnia midis GPN-s\u00eb dhe proceseve t\u00eb tjera t\u00eb BmK, dhe t\u00eb lidhura me k\u00ebt\u00eb, (3) v\u00ebshtir\u00ebsit\u00eb m\u00eb t\u00eb gjera rreth BmK n\u00eb Kosov\u00eb.<\/p>\n<p style=\"text-align: justify;\">1. Dinamika brenda GPN<\/p>\n<p style=\"text-align: justify;\">Procesi i GPN-s\u00eb, n\u00eb pjes\u00ebn m\u00eb t\u00eb madhe nuk ka pasur sukses t\u00eb krijoj\u00eb nj\u00eb mjedis t\u00eb favorsh\u00ebm p\u00ebr diskutimin e \u00e7\u00ebshtjeve thelb\u00ebsore lidhur me BmK dhe pajtimin n\u00eb Kosov\u00eb. Grupi ka<br \/>\n3 Edhe pse qeveria ka themeluar GPN n\u00eb qershor 2012, grupi u takua p\u00ebr her\u00eb t\u00eb par\u00eb n\u00eb mesin e vitit 2013, dhe Takimi 2 p\u00ebr Shk\u00ebmbimin e Informatave me p\u00ebrfaq\u00ebsues t\u00eb OShC-ve u zhvillua n\u00eb shkurt t\u00eb vitit 2014.<br \/>\n\u201cN\u00eb asnj\u00eb faz\u00eb nuk kishte ndonj\u00eb p\u00ebrfshirje nga parlamenti n\u00eb pun\u00ebn e grupit t\u00eb pun\u00ebs, pavar\u00ebsisht faktit se Komisioni i at\u00ebhersh\u00ebm parlamentar p\u00ebr t\u00eb Drejtat e Njeriut merrej me \u00e7\u00ebshtje t\u00eb drejt\u00ebsis\u00eb tranzicionale, si personat e zhdukur\u201d. (i anketuar me etni shqiptare)<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cP\u00ebr ta arritur dialogun, duhet t\u2019i kemi t\u00eb dyja pal\u00ebt n\u00eb bord. Nuk ia kemi dal\u00eb t\u2019i kemi t\u00eb dyja pal\u00ebt as brenda grupit\u201d. Kjo ka ndodhur p\u00ebr disa arsye:<br \/>\n&#8211; Gama e Strategjis\u00eb Komb\u00ebtare: Sa i p\u00ebrket gam\u00ebs s\u00eb veprimit t\u00eb Strategjis\u00eb Komb\u00ebtare t\u00eb ardhshme p\u00ebr Drejt\u00ebsin\u00eb Tranzicionale, ka pasur mosmarr\u00ebveshje t\u00eb konsiderueshme brenda GPN-s\u00eb n\u00ebse ajo duhet t\u00eb mbuloj\u00eb vet\u00ebm shkeljet e kryera deri n\u00eb vitin 1999, apo ta p\u00ebrfshij\u00eb periudh\u00ebn pas luft\u00ebs deri n\u00eb vitin 2001.<br \/>\n&#8211; P\u00ebrfaq\u00ebsimi i komunitetit pakic\u00eb: P\u00ebrfaq\u00ebsuesit e komuniteteve pakic\u00eb e shihnin veten si t\u00eb p\u00ebrjashtuar nga p\u00ebrb\u00ebrja dhe puna e GPN-s\u00eb. Disa mendonin se nuk u jepej mund\u00ebsia t\u00eb shprehin mendimin e tyre n\u00eb takime ose t\u00eb marrin pjes\u00eb n\u00eb m\u00ebnyr\u00eb dometh\u00ebn\u00ebse n\u00eb vendimmarrje. Udh\u00ebheq\u00ebsia e GPN-s\u00eb d\u00ebshtoi t\u00eb nd\u00ebrtonte besimin me p\u00ebrfaq\u00ebsuesit e shoq\u00ebris\u00eb civile t\u00eb komuniteteve pakic\u00eb, dhe nj\u00ebkoh\u00ebsisht asnj\u00eb p\u00ebrfaq\u00ebsues politik i komuniteteve pakic\u00eb nuk ka qen\u00eb pjes\u00eb e procesit. Shum\u00eb t\u00eb intervistuar iu referuan q\u00ebndrimit jodashamir\u00ebs ndaj p\u00ebrfaq\u00ebsuesve t\u00eb komuniteteve pakic\u00eb, i cili thoshin se nxitej nga Kryesuesi dhe Z\u00ebvend\u00ebskryesuesit e GPN-s\u00eb. Nj\u00eb p\u00ebrfaq\u00ebsues serb i OShC nuk merrte pjes\u00eb n\u00eb takime. P\u00ebr aq sa \u00e7\u00ebshtjet e BmK diskutoheshin brenda GPN-s\u00eb, an\u00ebtar\u00ebt prireshin t\u00eb p\u00ebrvet\u00ebsonin qasje t\u00eb nj\u00ebanshme dhe t\u00eb argumentonin vet\u00ebm p\u00ebr perspektiv\u00ebn e komuniteteve t\u00eb veta.<br \/>\n&#8211; Marr\u00ebdh\u00ebniet mes QK dhe shoq\u00ebris\u00eb civile n\u00eb BmK: GPN ka d\u00ebshtuar q\u00eb t\u2019i forcoj\u00eb marr\u00ebdh\u00ebniet mes QK dhe shoq\u00ebris\u00eb civile n\u00eb \u00e7\u00ebshtjet e BmK. Pavar\u00ebsisht prej shpresave fillestare q\u00eb angazhimi i p\u00ebrbashk\u00ebt do ta l\u00ebvizte agjend\u00ebn e drejt\u00ebsis\u00eb tranzicionale p\u00ebrpara, tani ka m\u00eb shum\u00eb mosbesim mes dy taborreve, e si pasoj\u00eb do p\u00ebrparimi i drejt\u00ebsis\u00eb tranzicionale p\u00ebr vitet n\u00eb vijim do t\u00eb ngadal\u00ebsohet. P\u00ebrgjegj\u00ebsia p\u00ebr k\u00ebt\u00eb situat\u00eb q\u00ebndron te t\u00eb dyja pal\u00ebt. P\u00ebrfaq\u00ebsuesit e QK nuk i kushtonin v\u00ebmendje t\u00eb mjaftueshme \u00e7\u00ebshtjes s\u00eb pron\u00ebsis\u00eb politike, e as adresimit t\u00eb munges\u00ebs s\u00eb ekspertiz\u00ebs p\u00ebrkat\u00ebse nga ana e tyre, si dhe nuk angazhoheshin p\u00ebr t\u2019u siguruar se grupi po menaxhohet n\u00eb m\u00ebnyr\u00eb efektive. Nga ana e vet, shoq\u00ebria civile, duke k\u00ebmb\u00ebngulur se vet\u00ebm ajo kishte ekspertiz\u00eb t\u00eb &#8220;v\u00ebrtet\u00eb&#8221; mbi drejt\u00ebsin\u00eb tranzicionale dhe duke mohuar se qeveria kishte ndonj\u00eb kompetenc\u00eb n\u00eb k\u00ebt\u00eb fush\u00eb, nuk e ndihmoi procesin e nd\u00ebrtimit t\u00eb besimit reciprok.<br \/>\n&#8211; Ndarjet e shoq\u00ebris\u00eb civile: P\u00ebrparimi n\u00eb \u00e7\u00ebshtjet e drejt\u00ebsis\u00eb tranzicionale n\u00eb nj\u00ebfar\u00eb mase u pengua nga dallimet brenda shoq\u00ebris\u00eb civile dhe nga fakti se OShC-t\u00eb nuk mund t\u00eb flisnin me nj\u00eb z\u00eb. Arsyet p\u00ebr k\u00ebto ndarje ishin t\u00eb paqarta, por k\u00ebrkojn\u00eb analiz\u00eb t\u00eb m\u00ebtejshme, ve\u00e7an\u00ebrisht n\u00eb lidhje me pavar\u00ebsin\u00eb politike t\u00eb an\u00ebtar\u00ebve t\u00eb GPN-s\u00eb.<br \/>\n&#8211; Bashk\u00ebsia nd\u00ebrkomb\u00ebtare kishte nj\u00eb rol ky\u00e7 n\u00eb p\u00ebrkrahjen e procesit t\u00eb GPN-s\u00eb. Ndon\u00ebse ofroi nj\u00ebrar\u00eb nd\u00ebrtimi kapacitetesh p\u00ebrmes trajnimeve dhe k\u00ebshillave t\u00eb ekspert\u00ebve, kjo p\u00ebrkrahje nuk kishte ndonj\u00eb vizion t\u00eb v\u00ebrtet\u00eb strategjik dhe mezi dep\u00ebrtonte n\u00ebp\u00ebr kontekstin shum\u00eb t\u00eb ndjesh\u00ebm politik. UNDP, q\u00eb veproi si sekretariat p\u00ebr GPN-ne me mb\u00ebshtetje financiare nga Qeveria e Zvicr\u00ebs, d\u00ebshtoi t\u00eb nd\u00ebrtonte nj\u00eb partneritet efektiv dhe proaktiv brenda grupit. Nj\u00eb partneritet i till\u00eb, n\u00eb faza t\u00eb ndryshme mund t\u2019i kishte ndihmuar GPN-s\u00eb p\u00ebr t\u2019i kap\u00ebrcyer pengesat t\u00eb nj\u00eb kontekst t\u00eb ndjesh\u00ebm e tejet politik, n\u00eb t\u00eb cilin po trajtoheshin \u00e7\u00ebshtje t\u00eb v\u00ebshtira e p\u00ebr\u00e7ar\u00ebse. Nj\u00eb qasje q\u00eb ishte politikisht e ndjeshme, m\u00eb par\u00eb se sa thjesht teknike e neutrale, do t\u00eb kish qen\u00eb m\u00eb efektive n\u00eb kund\u00ebrv\u00ebnien e forcave ndar\u00ebse.<\/p>\n<p>&#8211; Mungesa e transparenc\u00ebs p\u00ebr financimin, e lidhur me aktivitetet e donator\u00ebve nd\u00ebrkomb\u00ebtar\u00eb dhe me QK, m\u00eb tej p\u00ebrkeq\u00ebsoi mjedisin e pun\u00ebs s\u00eb GPN-s\u00eb dhe \u00e7oi n\u00eb tensione e konkurrenc\u00eb, ve\u00e7mas mes OShC-ve.<\/p>\n<p>2. Marr\u00ebdh\u00ebnia mes GPN dhe proceseve t\u00eb tjera t\u00eb BmK<\/p>\n<p>GPN, n\u00eb fakt, ishte spektator pasiv n\u00eb lidhje me zhvillimet e BmK n\u00eb Kosov\u00eb, n\u00eb vend se forc\u00eb aktive l\u00ebviz\u00ebse. Shumica e t\u00eb intervistuarve theksuan se GPN ishte shk\u00ebputur dhe izoluar nga proceset e tjera t\u00eb drejt\u00ebsis\u00eb tranzicionale q\u00eb po ndodhnin n\u00eb Kosov\u00eb dhe rajon. Ajo nuk u p\u00ebrfshi n\u00eb asnj\u00ebr\u00ebn nga \u00e7\u00ebshtjet kryesore t\u00eb BmK q\u00eb dol\u00ebn n\u00eb pah n\u00eb Kosov\u00eb n\u00eb vitet e m\u00ebparshme, duke p\u00ebrfshir\u00eb edhe shqet\u00ebsimet mbi gjykimet e vazhdueshme t\u00eb krimeve t\u00eb luft\u00ebs; krijimin e Dhomave Specialiste dhe t\u00eb Zyr\u00ebs Specialiste t\u00eb Prokuroris\u00eb p\u00ebr Kosov\u00ebn nga Kuvendi, n\u00eb bashk\u00ebpunim me Bashkimin Evropian (BE); iniciativ\u00ebn rajonale mbi t\u00eb v\u00ebrtet\u00ebn dhe pajtimin t\u00eb RECOM-it; zhvillimet n\u00eb fush\u00ebn e reparacioneve, duke p\u00ebrfshir\u00eb ato t\u00eb dhun\u00ebs seksuale; munges\u00ebn e progresit p\u00ebr \u00e7\u00ebshtjen e t\u00eb zhdukurve; dhe k\u00ebrkim faljen e Presidentit drejtuar komunitetit serb n\u00eb Kosov\u00eb p\u00ebr abuzime gjat\u00eb koh\u00ebs s\u00eb luft\u00ebs. Ve\u00e7an\u00ebrisht, GPN nuk u konsultua paraprakisht n\u00eb lidhje me iniciativ\u00ebn e Presidentit t\u00eb Kosov\u00ebs p\u00ebr krijimin e Komisionit p\u00ebr t\u00eb V\u00ebrtet\u00ebn dhe Pajtimin, i shpallur publikisht n\u00eb shkurt 2017.<\/p>\n<blockquote><p>\u201cPresidenti i Kosov\u00ebs do t\u00eb krijoj\u00eb nj\u00eb tjet\u00ebr organ p\u00ebr t\u00eb v\u00ebrtet\u00ebn dhe pajtimin. Ne nuk ishim t\u00eb p\u00ebrfshir\u00eb n\u00eb k\u00ebt\u00eb. N\u00ebse do t\u00eb kemi GPN dhe nj\u00eb tjet\u00ebr komision t\u00eb t\u00eb v\u00ebrtet\u00ebs, kjo pastaj do t\u00eb na shkaktoj\u00eb rr\u00ebmuj\u00eb\u201d. (i anketuar me etni shqiptare)<\/p><\/blockquote>\n<p>Po ashtu, proceset q\u00eb kan\u00eb ndikim t\u00eb drejtp\u00ebrdrejt\u00eb ose t\u00eb t\u00ebrthort\u00eb mbi drejt\u00ebsin\u00eb tranzicionale dhe zbatimin e saj n\u00eb Kosov\u00eb, si dialogu i leht\u00ebsuar nga BE-ja mes Prishtin\u00ebs e Beogradit dhe diskutimet me BE-n\u00eb mbi Marr\u00ebveshjen e Stabilizim-Asociimit (MSA)4, nuk u konsideruan nga fush\u00ebveprimi i GPN-s\u00eb. Me fjal\u00eb t\u00eb tjera, grupi operonte n\u00eb vakum, pa u nd\u00ebrlidhur me proceset e tjera q\u00eb jan\u00eb megjithat\u00eb t\u00eb r\u00ebnd\u00ebsishme p\u00ebr p\u00ebrmbushjen e mandatit t\u00eb vet themelor p\u00ebr t&#8217;u marr\u00eb me \u00e7\u00ebshtjet e drejt\u00ebsis\u00eb tranzicionale dhe pajtimin.<br \/>\nKjo shk\u00ebputje dhe izolim i GPN-s\u00eb hedh dyshime n\u00ebse Qeveria e Kosov\u00ebs ka pasur ndonj\u00eb zotim t\u00eb v\u00ebrtet\u00eb politik dhe pron\u00ebsi ndaj procesit t\u00eb GPN-s\u00eb. Ajo gjithashtu ngre disa pyetje serioze lidhur me kuptimin e v\u00ebrtet\u00eb dhe q\u00ebllimin e nj\u00eb Strategjie Komb\u00ebtare p\u00ebr Drejt\u00ebsin\u00eb Tranzicionale. Idealisht, GPN duhet t\u00eb ishte motori politik dhe teknik i nj\u00eb kornize gjith\u00ebp\u00ebrfshir\u00ebse p\u00ebr drejt\u00ebsin\u00eb tranzicionale n\u00eb Kosov\u00eb, p\u00ebrmes hartimit t\u00eb Strategjis\u00eb Komb\u00ebtare t\u00eb dal\u00eb nga rezultati i konsultimeve komb\u00ebtare. N\u00eb vend t\u00eb k\u00ebsaj, GPN kishte nj\u00eb qasje pjes\u00eb-pjes\u00eb ndaj drejt\u00ebsis\u00eb tranzicionale duke qen\u00eb m\u00eb shum\u00eb i p\u00ebrgjegjsh\u00ebm ndaj p\u00ebrshtatshm\u00ebris\u00eb politike dhe obligimeve t\u00eb PGjS-s\u00eb sesa ndaj q\u00ebllimit kuptimplot\u00eb t\u00eb transformimit shoq\u00ebror. N\u00ebse GPN-ja nuk \u00ebsht\u00eb n\u00eb gjendje t\u00eb form\u00ebsoj ose t\u00eb kontribuoj\u00eb n\u00eb agjend\u00ebn m\u00eb t\u00eb gjer\u00eb t\u00eb BmK n\u00eb Kosov\u00eb, vlera e saj aktuale \u00ebsht\u00eb e diskutueshme.<\/p>\n<p>3. V\u00ebshtir\u00ebsit\u00eb m\u00eb t\u00eb gjera lidhur me BmK n\u00eb Kosov\u00eb<\/p>\n<p>Konteksti kompleks dhe i ndryshuesh\u00ebm i BmK n\u00eb Kosov\u00eb ka nj\u00eb ndikim t\u00eb drejtp\u00ebrdrejt\u00eb mbi efektivitetin e GPN-s\u00eb. Nuk \u00ebsht\u00eb q\u00ebllimi i k\u00ebtij shqyrtimit t\u00eb pun\u00ebs s\u00eb GPN q\u00eb t\u00eb ofroj\u00eb nj\u00eb vler\u00ebsim t\u00eb gjendjes s\u00eb drejt\u00ebsis\u00eb tranzicionale n\u00eb Kosov\u00eb. Megjithat\u00eb, mungesa e progresit t\u00eb b\u00ebr\u00eb nga grupi \u00ebsht\u00eb tregues i problemeve q\u00eb e pengojn\u00eb dhe e rr\u00ebnojn\u00eb progresin n\u00eb fush\u00ebn e BmK m\u00eb gjer\u00ebsisht. N\u00eb nivelin politik, ajo p\u00ebrfshin nd\u00ebrveprimin nd\u00ebrmjet QK dhe komunitetit nd\u00ebrkomb\u00ebtar. N\u00eb nivelin shoq\u00ebror dhe kulturor, p\u00ebrfshin shoq\u00ebrin\u00eb civile dhe politikan\u00ebt.<br \/>\n-N\u00eb nivelin politik, drejt\u00ebsia tranzicionale mund t\u00eb shihet si mjet q\u00eb p\u00ebrdoret n\u00eb p\u00ebrpjekjet p\u00ebr t\u00eb arritur paqen nd\u00ebrmjet dy komuniteteve. Shkopi i ndjekjeve penale, i perceptuar si mjeti m\u00eb detyrues n\u00eb kutin\u00eb e drejt\u00ebsis\u00eb tranzicionale, \u00ebsht\u00eb aplikuar nga institucionet e bashk\u00ebsis\u00eb nd\u00ebrkomb\u00ebtare (duke p\u00ebrfshir\u00eb Misionin e OKB-s\u00eb n\u00eb Kosov\u00eb, Tribunalin Nd\u00ebrkomb\u00ebtar p\u00ebr Krime Lufte n\u00eb ish-Jugosllavi, dhe sot Misionin e BE-s\u00eb p\u00ebr Sundimin e Ligjit, EULEX) si nj\u00eb mjet p\u00ebr ta bindur Qeverin\u00eb e Kosov\u00ebs q\u00eb t\u00eb marr\u00eb vendime politike &#8220;t\u00eb drejta&#8221;. Mekanizmat e tjer\u00eb kalimtar\u00eb t\u00eb drejt\u00ebsis\u00eb q\u00eb shpesh m\u00eb drejtp\u00ebrdrejt plot\u00ebsojn\u00eb nevojat e viktimave dhe t\u00eb shoq\u00ebris\u00eb n\u00eb p\u00ebrgjith\u00ebsi, si reparacionet dhe komisionet e t\u00eb v\u00ebrtet\u00ebs, nuk jan\u00eb promovuar aq fuqish\u00ebm nga komuniteti nd\u00ebrkomb\u00ebtar. Mandati i GPN-s\u00eb \u00ebsht\u00eb i duksh\u00ebm n\u00eb k\u00ebt\u00eb drejtim, n\u00eb at\u00eb q\u00eb adreson nevojat m\u00eb t\u00eb gjera t\u00eb shoq\u00ebris\u00eb si pasoj\u00eb e abuzimeve t\u00eb r\u00ebnda. Megjithat\u00eb, komuniteti nd\u00ebrkomb\u00ebtar deri m\u00eb tani nuk ka ofruar mb\u00ebshtetje p\u00ebr nj\u00eb agjend\u00eb m\u00eb t\u00eb plot\u00eb p\u00ebr BmK, si\u00e7 n\u00ebnvizohet n\u00eb mandatin e GPN-s\u00eb. Me fjal\u00eb t\u00eb tjera, drejt\u00ebsia tranzicionale, e par\u00eb si p\u00ebrgjigje gjith\u00ebp\u00ebrfshir\u00ebse ndaj abuzimeve t\u00eb luft\u00ebs s\u00eb fundit, nuk \u00ebsht\u00eb par\u00eb si prioritet p\u00ebr komunitetin nd\u00ebrkomb\u00ebtar n\u00eb Kosov\u00eb.<br \/>\n&#8211; Niveli shoq\u00ebror dhe kulturor vazhdon t\u00eb dominohet, si\u00e7 e shprehu nj\u00eb analist \u201cnga politika e identitetit dhe ndarja e trazicionit postkonfliktual n\u00eb Kosov\u00eb nga elitat nacionaliste\u201d, \u00e7ka ka rr\u00ebnuar \u201cperspektivat shoq\u00ebrore p\u00ebr ta th\u00ebn\u00eb dhe k\u00ebrkuar t\u00eb v\u00ebrtet\u00ebn lidhur me t\u00eb kaluar\u00ebn5\u201d. N\u00eb k\u00ebt\u00eb nivel, e kaluara e koh\u00ebs s\u00eb luft\u00ebs shfryt\u00ebzohet nga politikan\u00ebt p\u00ebr ta konsoliduar pushtetin e tyre. Politikan\u00ebt e mbajn\u00eb t\u00eb kaluar\u00ebn gjall\u00eb dhe e p\u00ebrdorin si l\u00ebnd\u00eb djeg\u00ebse p\u00ebr nacionalizmin q\u00eb i mban ata n\u00eb pushtet. P\u00ebrderisa qytetar\u00ebt mund t\u2019i artikulojn\u00eb t\u00eb drejtat dhe interesat e tyre n\u00eb kund\u00ebrshtim me korrupsionin dhe krimin e organizuar, kur b\u00ebhet fjal\u00eb p\u00ebr diskutimet mbi \u00e7\u00ebshtjet e BmK, vuajtja kolektive dhe solidariteti grupor g\u00ebzojn\u00eb p\u00ebrpar\u00ebsi mbi t\u00eb drejtat dhe interesat individuale.<br \/>\nGPN nuk ia ka dal\u00eb ta adresoj\u00eb ndonj\u00eb nga k\u00ebto probleme m\u00eb t\u00eb gjera q\u00eb pengojn\u00eb progresin e BmK n\u00eb Kosov\u00eb.<\/p>\n<p style=\"text-align: justify;\">3.3. P\u00ebrfundimeP\u00ebrfundimeP\u00ebrfundimeP\u00ebrfundime<\/p>\n<p style=\"text-align: justify;\">GPN, t\u00eb pakt\u00ebn si\u00e7 q\u00ebndron sot, nuk mund t\u00eb konsiderohet si instrument efektiv p\u00ebr nxjerrjen e nj\u00eb Strategjie Komb\u00ebtare p\u00ebr Drejt\u00ebsin\u00eb Tranzicionale me potencial p\u00ebr t\u00eb kontribuar n\u00eb transformimin shoq\u00ebror. Ka rrezik t\u00eb lart\u00eb se GPN do t\u00eb d\u00ebshtoj\u00eb n\u00eb p\u00ebrmbushjen e mandatit t\u00eb tij. Plani i Presidentit p\u00ebr t\u00eb krijuar nj\u00eb Komision p\u00ebr t\u00eb V\u00ebrtet\u00ebn dhe Pajtimin, i shfaqur befasisht dhe pa konsultime paraprake, ngre spektrin e konfuzionit nd\u00ebrinstitucional dhe t\u00eb konkurrenc\u00ebs, si dhe mjaft pyetje lidhur me besueshm\u00ebrin\u00eb e GPN-s\u00eb p\u00ebr hartimin e nj\u00eb Strategjie gjith\u00ebp\u00ebrfshir\u00ebse Komb\u00ebtare.<br \/>\nPa angazhim t\u00eb ringjallur nga QK, procesi i GPN-s\u00eb ka gjasa t\u00eb shpartallohet, duke mos hartuar Strategji Komb\u00ebtare fare, ose t\u00eb nxitoj\u00eb q\u00eb t\u00eb nxjerr\u00eb nj\u00eb Strategji Komb\u00ebtare t\u00eb cil\u00ebs i mungon legjitimiteti dhe besueshm\u00ebria e nevojshme p\u00ebr t&#8217;u marr\u00eb n\u00eb m\u00ebnyr\u00eb efektive me t\u00eb kaluar\u00ebn dhe p\u00ebr t\u00eb parandaluar shkeljet n\u00eb t\u00eb ardhmen. Nd\u00ebr OShC-t\u00eb e BmK n\u00eb Kosov\u00eb ka shqet\u00ebsime t\u00eb r\u00ebnda se \u00e7do Strategji Komb\u00ebtare eventuale do t\u00eb jet\u00eb nj\u00eb pun\u00eb \u201ckopjo e posto&#8221;, duke u bazuar n\u00eb strategjit\u00eb komb\u00ebtare t\u00eb drejt\u00ebsis\u00eb tranzicionale nga vende t\u00eb tjera t\u00eb rajonit dhe duke reflektuar munges\u00ebn e vullnetit politik dhe munges\u00ebn e dialogut t\u00eb v\u00ebrtet\u00eb brenda Kosov\u00ebs mbi \u00e7\u00ebshtjet e BmK.<br \/>\nT\u00eb anketuarit e kishin t\u00eb qart\u00eb se k\u00ebrkohet udh\u00ebheq\u00ebsi e re q\u00eb posedon guximin p\u00ebr ta thyer bllokimin dhe p\u00ebr t\u00eb krijuar nj\u00eb vizion p\u00ebr t\u00eb ardhmen e Kosov\u00ebs q\u00eb siguron mosp\u00ebrs\u00ebritjen e krimeve t\u00eb kaluara. T\u00eb intervistuarit theksuan r\u00ebnd\u00ebsin\u00eb e arsimit dhe shpreh\u00ebn nj\u00eb interes t\u00eb fort\u00eb p\u00ebr ta par\u00eb pun\u00ebn e BmK t\u00eb p\u00ebrqendrohet n\u00eb k\u00ebt\u00eb fush\u00eb. Ky shqyrtim po ashtu theksoi nevoj\u00ebn p\u00ebr ta forcuar shoq\u00ebrin\u00eb civile, n\u00eb m\u00ebnyr\u00eb q\u00eb ajo t\u00eb mund t\u00eb luaj\u00eb rol t\u00eb monitorimit dhe t\u00eb llogaridh\u00ebnies n\u00eb nivel institucional, si dhe n\u00eb negociatat e vazhdueshme politike dhe proceset e nd\u00ebrlidhura.<br \/>\nS\u00eb fundi, bashk\u00ebsia nd\u00ebrkomb\u00ebtare ka nj\u00eb p\u00ebrgjegj\u00ebsi t\u00eb ve\u00e7ant\u00eb p\u00ebr t\u00eb ndihmuar GPN-n\u00eb, pasi ka hartuar korniz\u00ebn ekzistuese t\u00eb Kosov\u00ebs p\u00ebr BmK p\u00ebrmes PGjS-s\u00eb. Aleat\u00ebt kryesor\u00eb t\u00eb Kosov\u00ebs, si Shtetet e Bashkuara, BE-ja dhe disa shtete kryesore an\u00ebtare t\u00eb BE-s\u00eb q\u00eb e njohin pavar\u00ebsin\u00eb e Kosov\u00ebs, duhet ta p\u00ebrdorin ndikimin e tyre te QK p\u00ebr ta mb\u00ebshtetur nj\u00eb korniz\u00eb gjith\u00ebp\u00ebrfshir\u00ebse t\u00eb BmK. Nuk duhet t\u00eb ket\u00eb vonesa n\u00eb plot\u00ebsimin e nevojave t\u00eb drejt\u00ebsis\u00eb p\u00ebr viktimat dhe t\u00eb shoq\u00ebris\u00eb n\u00eb p\u00ebrgjith\u00ebsi. Po q\u00eb se mbeten t\u00eb paadresuara dhe n\u00eb duar t\u00eb politik\u00ebs, k\u00ebto nevoja do t\u00eb ngjallin konflikt t\u00eb m\u00ebtejm\u00eb.<\/p>\n<p style=\"text-align: justify;\">4. Rekomandime<\/p>\n<p style=\"text-align: justify;\">Shqyrtimi i pun\u00ebs s\u00eb GPN-s\u00eb arrin n\u00eb p\u00ebrfundimin se n\u00ebse procesi i GPN-s\u00eb vazhdon n\u00eb form\u00ebn e tanishme, ai rrezikon t\u00eb d\u00ebshtoj\u00eb n\u00eb ofrimin e detyr\u00ebs s\u00eb mandatuar. Shum\u00eb v\u00ebzhgues, p\u00ebrfshir\u00eb edhe an\u00ebtar\u00ebt e bashk\u00ebsis\u00eb nd\u00ebrkomb\u00ebtare, besojn\u00eb se procesi i GPN-s\u00eb tani po p\u00ebrballet me shansin e vet t\u00eb fundit. P\u00ebr ta shmangur d\u00ebshtimin total, duhet t\u00eb trajtohen urgjentisht sfidat procedurale dhe thelb\u00ebsore t\u00eb lartp\u00ebrmendura. K\u00ebrkohet zotim i qart\u00eb politik p\u00ebr t\u00eb krijuar nj\u00eb proces t\u00eb mir\u00ebfillt\u00eb q\u00eb \u00e7on n\u00eb rezultate pozitive, dhe n\u00ebse kjo pason, p\u00ebrs\u00ebri mund t\u00eb ket\u00eb p\u00ebrfshirje nga t\u00eb gjitha pal\u00ebt e interesuara.<\/p>\n<p style=\"text-align: justify;\">4.1 Rekomandime p\u00ebr Qeverin\u00eb e Kosov\u00ebs<\/p>\n<p style=\"text-align: justify;\">-P\u00ebr ta shp\u00ebtuar procesin e GPN-s\u00eb, Qeveria e Kosov\u00ebs duhet urgjentisht t\u00eb komunikoj\u00eb p\u00ebrkrahjen p\u00ebr procesin n\u00eb nivelin m\u00eb t\u00eb lart\u00eb politik, dhe t\u00eb ritheksoj\u00eb angazhimin p\u00ebr nj\u00eb qasje gjith\u00ebp\u00ebrfshir\u00ebse, t\u00ebr\u00ebsore dhe me ndjeshm\u00ebri gjinore p\u00ebr BmK n\u00eb Kosov\u00eb.<br \/>\n&#8211; Kjo duhet t\u00eb ndiqet nga masa konkrete p\u00ebr ta nd\u00ebrtuar besimin me p\u00ebrfaq\u00ebsuesit e shoq\u00ebris\u00eb civile dhe t\u00eb komuniteteve pakic\u00eb. K\u00ebto masa duhet t\u00eb p\u00ebrfshijn\u00eb rregullimet strukturore p\u00ebr t\u2019i trajtuar problemet procedurale dhe thelb\u00ebsore t\u00eb identifikuara n\u00eb k\u00ebt\u00eb studim, p\u00ebr shembull, duke e b\u00ebr\u00eb t\u00eb mundshme q\u00eb t\u00eb z\u00ebvend\u00ebsohet Kryesuesi dhe z\u00ebvend\u00ebskryesuesit, si dhe duke em\u00ebruar m\u00eb shum\u00eb zyrtar\u00eb t\u00eb lart\u00eb publik\u00eb me aft\u00ebsin\u00eb p\u00ebr t\u00eb folur n\u00eb em\u00ebr t\u00eb institucioneve p\u00ebrkat\u00ebse.<br \/>\n&#8211; Paraqitja e raporteve vjetore para Komisionit t\u00eb Kuvendit t\u00eb Kosov\u00ebs p\u00ebr t\u00eb Drejtat e Njeriut, Persona t\u00eb Pagjetur dhe Peticione do ta promovonte mbik\u00ebqyrjen e aktiviteteve t\u00eb GPN-s\u00eb.<br \/>\n&#8211; Puna e GPN-s\u00eb duhet t\u00eb jet\u00eb m\u00eb mir\u00eb e nd\u00ebrlidhur me proceset e tjera q\u00eb nd\u00ebrlidhen me drejt\u00ebsin\u00eb tranzicionale n\u00eb Kosov\u00eb. K\u00ebto p\u00ebrfshijn\u00eb proceset q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me paditjen, reparacionet, k\u00ebrkimin e t\u00eb v\u00ebrtet\u00ebs dhe reform\u00ebn institucionale, por edhe nd\u00ebrtimin e paqes dhe proceset e pajtimit, si dhe dialogun rreth an\u00ebtar\u00ebsimit n\u00eb BE. Nd\u00ebrlidhjet me procese t\u00eb tilla duhet t\u00eb jen\u00eb nj\u00eb element i r\u00ebnd\u00ebsish\u00ebm n\u00eb agjend\u00ebn e GPN-s\u00eb, dhe ekspert\u00ebt e p\u00ebrfshir\u00eb n\u00eb k\u00ebto procese, si vendor\u00eb edhe ata nd\u00ebrkomb\u00ebtar\u00eb, duhet t\u00eb ftohen q\u00eb t\u00eb marrin pjes\u00eb n\u00eb m\u00ebnyr\u00eb aktive n\u00eb grupin e pun\u00ebs.<br \/>\n&#8211; Duhen b\u00ebr\u00eb p\u00ebrpjekje t\u00eb reja p\u00ebr t\u00eb dep\u00ebrtuar te komuniteti nd\u00ebrkomb\u00ebtar p\u00ebr p\u00ebrkrahje, si teknike poashtu edhe politike. BE-ja duhet t\u00eb jet\u00eb nj\u00eb partner ky\u00e7: zhvillimi i nj\u00eb Strategjie Komb\u00ebtare p\u00ebr drejt\u00ebsin\u00eb tranzicionale \u00ebsht\u00eb prioritet i qart\u00eb n\u00eb Programin Komb\u00ebtar p\u00ebr Zbatimin e MSA-s\u00eb dhe BE-ja koh\u00ebt e fundit ka miratuar korniz\u00ebn e vet t\u00eb politik\u00ebs mbi drejt\u00ebsin\u00eb tranzicionale. Kryesuesi i GPN-s\u00eb dhe dy z\u00ebvend\u00ebskryesues e an\u00ebtar\u00eb nga shoq\u00ebria civile duhet rregullisht t\u00eb njoftojn\u00eb ambasador\u00ebt e Shteteve An\u00ebtare t\u00eb BE-s\u00eb n\u00eb Prishtin\u00eb p\u00ebr pun\u00ebn e grupit.<br \/>\n&#8211; Strategjia e GPN-s\u00eb p\u00ebr komunikim dhe avokim duhet t\u00eb ridizajnohet p\u00ebr ta b\u00ebr\u00eb m\u00eb p\u00ebrfshir\u00ebse pun\u00ebn e GPN-s\u00eb, n\u00eb pajtim me mandatin e GPN-s\u00eb dhe rregullat e veta t\u00eb procedur\u00ebs. Avokimi duhet t\u00eb marr\u00eb n\u00eb konsiderat\u00eb ndjeshm\u00ebrit\u00eb politike rreth \u00e7\u00ebshtjeve t\u00eb BmK dhe nuk duhet t\u00eb jet\u00eb i nj\u00ebansh\u00ebm; Zyra e Komisionerit t\u00eb Lart\u00eb t\u00eb OKB-s\u00eb p\u00ebr t\u00eb Drejtat e Njeriut duhet t\u00eb ftohet p\u00ebr t\u00eb dh\u00ebn\u00eb udh\u00ebzime dhe p\u00ebrkrahje. Nj\u00eb Task Force avokimi dhe komunikimi mund t\u00eb krijohet brenda grupit, duke p\u00ebrfshir\u00eb pjes\u00ebtar\u00ebt e t\u00eb gjitha komuniteteve.<br \/>\n&#8211; K\u00ebrkohet planifikim m\u00eb gjith\u00ebp\u00ebrfshir\u00ebs dhe i detajuar para se t\u00eb zbatohen konsultimet nacionale. Nj\u00eb studim fizibiliteti duhet t\u00eb nd\u00ebrmerret nga nj\u00eb ekspert i pavarur mbi q\u00ebllimin, modalitetet dhe rreziqet e konsultimeve. Nj\u00eb studim i till\u00eb duhet t\u00eb mbuloj\u00eb edhe marr\u00ebdh\u00ebniet mes konsultimeve komb\u00ebtare dhe procesin e krijimit t\u00eb Komisionit t\u00eb ardhsh\u00ebm p\u00ebr t\u00eb V\u00ebrtet\u00ebn dhe Pajtimin. E gjith\u00eb kjo duhet t\u00eb b\u00ebhet urgjentisht dhe n\u00eb bashk\u00ebpunim t\u00eb ngusht\u00eb me p\u00ebrfaq\u00ebsuesit e komuniteteve pakic\u00eb n\u00eb Kosov\u00eb, si OShC-t\u00eb, si udh\u00ebheq\u00ebsit politik\u00eb. Duhet t\u00eb mbahen sa m\u00eb shpejt diskutime n\u00ebse GPN-ja \u00ebsht\u00eb e aft\u00eb p\u00ebr t\u00eb sh\u00ebrbyer si lidere p\u00ebr konsultime t\u00eb gjera komb\u00ebtare, apo n\u00ebse duhet t\u00eb parashihet nj\u00eb struktur\u00eb e re dhe m\u00eb e pavarur.<br \/>\n&#8211; Propozimi p\u00ebr ngritjen e Komisioneve t\u00eb s\u00eb V\u00ebrtet\u00ebs dhe Pajtimit duhet t\u00eb shqyrtohet p\u00ebrmes nj\u00eb debati t\u00eb gjer\u00eb dhe gjith\u00ebp\u00ebrfshir\u00ebs komb\u00ebtar, me q\u00ebllim t\u00eb nd\u00ebrtimit t\u00eb koncensusit rreth q\u00ebllimit dhe fush\u00ebveprimit t\u00eb nj\u00eb komisioni t\u00eb till\u00eb. Diskutimet po ashtu duhet t\u00eb b\u00ebhen brenda GPN-s\u00eb.<\/p>\n<p style=\"text-align: justify;\">4.2 Rekomandime p\u00ebr shoq\u00ebrin\u00eb civile<\/p>\n<p style=\"text-align: justify;\">-Shoq\u00ebria civile duhet t\u00eb jet\u00eb m\u00eb strategjike n\u00eb qasjen e vet mbi drejt\u00ebsin\u00eb tranzicionale n\u00eb Kosov\u00eb. Ajo duhet t\u00eb flas\u00eb me nj\u00eb z\u00eb dhe ta krijoj\u00eb nj\u00eb vizion p\u00ebr BmK q\u00eb kuptohet leht\u00eb dhe komunikohet gjer\u00ebsisht. Strategjia e saj duhet t\u00eb p\u00ebrfshij\u00eb: hartimin e mesazheve konkrete p\u00ebr t\u00eb shpjeguar pse BmK \u00ebsht\u00eb i r\u00ebnd\u00ebsish\u00ebm p\u00ebr Kosov\u00ebn, duke p\u00ebrfshir\u00eb edhe perspektiv\u00ebn gjinore; p\u00ebrcaktimin e standardeve afatshkurtra dhe afatgjata p\u00ebr ta matur progresin; nxjerrjen e nj\u00eb vler\u00ebsimi t\u00eb detajuar teknik dhe pasqyrimin e asaj q\u00eb \u00ebsht\u00eb b\u00ebr\u00eb deri m\u00eb tani n\u00eb drejt\u00ebsin\u00eb tranzicionale, si dhe ku vazhdojn\u00eb boshll\u00ebqet. An\u00ebtar\u00eb t\u00eb shoqatave t\u00eb viktimave dhe p\u00ebrfaq\u00ebsues t\u00eb OShC-ve t\u00eb komuniteteve pakic\u00eb duhet t\u00eb integrohen dhe t\u00eb marrin pjes\u00eb aktive n\u00eb hartimin e nj\u00eb qasjeje t\u00eb till\u00eb strategjike.<br \/>\n&#8211; Shoq\u00ebria civile duhet t\u00eb investoj\u00eb n\u00eb forcimin e ekspertiz\u00ebs s\u00eb vet rreth nd\u00ebrveprimit me proceset politike dhe negociatat p\u00ebrgjith\u00ebsisht, si dhe me m\u00ebnyr\u00ebn se si funksionon qeveria. Kjo mund t\u00eb b\u00ebhet n\u00ebp\u00ebrmjet shk\u00ebmbimeve mes koleg\u00ebsh me OShC-t\u00eb nga vende t\u00eb tjera q\u00eb kan\u00eb p\u00ebrvoj\u00eb n\u00eb k\u00ebt\u00eb drejtim. Perspektiva gjinore duhet t\u00eb integrohet n\u00eb k\u00ebto shk\u00ebmbime. K\u00ebshilla dhe trajnime mbi lobimin dhe monitorimin p\u00ebr angazhimin politik me institucionet po ashtu mund t\u00eb k\u00ebrkohen nga bashk\u00ebsia nd\u00ebrkomb\u00ebtare.<br \/>\n&#8211; Shoq\u00ebria civile duhet t\u00eb kryej\u00eb k\u00ebrkime se si mund t\u00eb zhvillohet nj\u00eb strategji efektive avokimi dhe komunikimi p\u00ebr GPN-n\u00eb.
