Analogjia me marr\u00ebdh\u00ebniet nd\u00ebr njer\u00ebzore dhe me marr\u00ebdh\u00ebniet brenda ose midis kolektivave t\u00eb ndryshme shoq\u00ebrore \u00ebsht\u00eb problematike, sepse n\u00eb m\u00ebnyr\u00eb uniforme i trajton q\u00ebndrimet dhe perceptimin e t\u00eb gjith\u00eb pjes\u00ebtar\u00ebve t\u00eb shoq\u00ebris\u00eb, duke synuar q\u00eb t\u2019i reduktoj\u00eb n\u00eb q\u00ebndrime zyrtare t\u00eb qeverive t\u00eb tyre.<\/p>\n<p>Megjith\u00ebk\u00ebt\u00eb, nga t\u00eb gjitha konceptet n\u00eb k\u00ebt\u00eb barazim, me gjas\u00eb m\u00eb kontradiktori \u00ebsht\u00eb koncepti i \u201cs\u00eb v\u00ebrtet\u00ebs\u201d. T\u00eb flas\u00ebsh mbi \u201ct\u00eb v\u00ebrtet\u00ebn\u201d n\u00eb kontekst t\u00eb nj\u00eb vargu t\u00eb t\u00ebr\u00eb t\u00eb konflikteve t\u00eb dhunshme (aktivitetet e t\u00eb cilave paraprakisht ose m\u00eb pastaj jan\u00eb fshehur, n\u00eb t\u00eb cilat kan\u00eb qen\u00eb t\u00eb p\u00ebrfshira lloje t\u00eb ndryshme t\u00eb institucioneve dhe n\u00eb t\u00eb cilat thell\u00ebsisht jan\u00eb t\u00eb rr\u00ebnjosura ndjenjat e keqp\u00ebrdorimit p\u00ebr mobilizim t\u00eb p\u00ebrkrahjes p\u00ebr projektet politike) \u2013 n\u00eb t\u00eb v\u00ebrtet\u00eb e imponon nj\u00eb nivel t\u00eb siguris\u00eb dhe t\u00eb qart\u00ebsis\u00eb n\u00eb lidhje me disa \u00e7\u00ebshtje kontestuese, t\u00eb cilat edhe m\u00eb tutje n\u00eb mas\u00eb t\u00eb madhe jan\u00eb kontradiktore ose t\u00eb panjohura. Kur nj\u00eb grup i ish t\u00eb burgosurve n\u00eb kampet e p\u00ebrqendrimit ka theksuar sloganin \u201eheshtja \u00ebsht\u00eb bashk\u00ebpjes\u00ebmarr\u00ebs\u201c (26 qershor t\u00eb vitit 2014, <a href=\"http:\/\/radiosarajevo.ba\/novost\/156576\/foto-podrska-zrtvama-torture-iz-sarajeva-tisina-je-saucesnik\">http:\/\/radiosarajevo.ba\/novost\/156576\/foto-podrska-zrtvama-torture-iz-sarajeva-tisina-je-saucesnik#<\/a>), ata, n\u00eb t\u00eb v\u00ebrtet\u00eb, kan\u00eb folur p\u00ebr t\u00eb v\u00ebrtet\u00ebn, e cila rrjedh nga p\u00ebrvojat e tyre dhe nga bindja e tyre se nevojat e viktimave n\u00eb mas\u00eb t\u00eb madhe kan\u00eb mbetur t\u00eb paplot\u00ebsuara. Kur peshkopi i Sisakut Imzot Vlado Koshiqi e ka sh\u00ebrbyer mesh\u00ebn n\u00eb pritje t\u00eb nj\u00eb t\u00eb d\u00ebnuari (pastaj t\u00eb liruar) kriminal (t\u00eb cilin n\u00eb at\u00eb moment e ka p\u00ebrshkruar si nj\u00eb \u201egur moral\u201c sepse ka refuzuar p\u00ebr t\u00eb d\u00ebshmuar kund\u00ebr urdh\u00ebrdh\u00ebn\u00ebsve t\u00eb tij \u2013 20 qershor i vitit 2014, <a href=\"http:\/\/www.jutarnji.hr\/biskup-kosic--krdic-je-nepravedno-osuden\/1200426\/\">http:\/\/www.jutarnji.hr\/biskup-kosic\u2013krdic-je-nepravedno-osuden\/1200426\/<\/a>), ai po ashtu ka folur p\u00ebr t\u00eb v\u00ebrtet\u00ebn, e cila \u00ebsht\u00eb nxjerr\u00eb nga qarqe lojalitete t\u00eb caktuara komplekse institucionale dhe politike. N\u00eb ambientin post-konfliktual, n\u00eb t\u00eb v\u00ebrtet\u00eb, ekzistojn\u00eb t\u00eb v\u00ebrteta t\u00eb shumta inkompatibile, t\u00eb cilat i b\u00ebjn\u00eb konkurrenc\u00eb nj\u00ebra-tjetr\u00ebs. T\u00eb p\u00ebrbashk\u00ebt e kan\u00eb at\u00eb se nj\u00eb grup t\u00eb caktuar t\u00eb fakteve e lidhin p\u00ebr nj\u00eb sistem t\u00eb caktuar t\u00eb vlerave dhe t\u00eb interesave.<\/p>\n<p>Ajo q\u00eb nuk e kemi dhe q\u00eb, me gjas\u00eb, kurr\u00eb nuk do ta kemi, \u00ebsht\u00eb konsensusi p\u00ebr \u201ct\u00eb v\u00ebrtet\u00ebn\u201d universale. N\u00ebse ndonj\u00ebher\u00eb do t\u00eb arrihet, ai mund t\u00eb p\u00ebrfaq\u00ebsoj\u00eb vet\u00ebm \u201crealizim t\u00eb ndonj\u00eb objektivi politik, por assesi t\u00eb nj\u00eb q\u00ebllimi, i cili rrjedh ekskluzivisht ngas proceset ligjore ose nga hulumtimet.<\/p>\n<p>At\u00ebher\u00eb, \u00e7ka \u00ebsht\u00eb objektivi i arritsh\u00ebm? N\u00ebse nocioni i s\u00eb \u201c\u00eb v\u00ebrtet\u00ebs\u201d duket tejet ambicioz dhe i n\u00ebnshtruesh\u00ebm ndaj manipulimeve dhe keqp\u00ebrdorimeve, at\u00ebher\u00eb di\u00e7ka m\u00eb e kufizuar \u2013 si\u00e7 \u00ebsht\u00eb konstatimi i fakteve \u2013 do t\u00eb mund t\u00eb na e ofronte nj\u00eb pik\u00eb nism\u00ebtare m\u00eb t\u00eb mir\u00eb. K\u00ebshtu, edhe n\u00eb diskursin juridik, mbi gjykatat flitet si p\u00ebr \u201eorgane, t\u00eb cilat i konstatojn\u00eb faktet\u201c. N\u00eb shum\u00eb pik\u00ebpamje, do t\u00eb mund t\u00eb thuhej se dokumentacioni nga proceset gjyq\u00ebsore i ka kontribuuar konstatimit t\u00eb nj\u00eb numri t\u00eb madh t\u00eb fakteve t\u00eb pakund\u00ebrshtueshme si dhe se materiali i prezantuar mund\u00ebson q\u00eb t\u00eb m\u00ebsojm\u00eb edhe m\u00eb shum\u00eb.<\/p>\n<p>N\u00eb k\u00ebt\u00eb pik\u00ebpamje, do t\u00eb mund t\u00eb pritej q\u00eb proceset penale n\u00eb mas\u00eb t\u00eb madhe do t\u00eb na ofrojn\u00eb nga v\u00ebrtetimi i fakteve mbi konfliktin dhe n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb do t\u2019i kontribuojn\u00eb nd\u00ebrtimit t\u00eb t\u00eb \u201cv\u00ebrtetave\u201d m\u00eb t\u00eb besueshme dhe t\u00eb p\u00ebrbashk\u00ebta. Megjith\u00ebk\u00ebt\u00eb, \u00ebsht\u00eb e qart\u00eb se institucionet e t\u00eb drejt\u00ebs penale nuk e kan\u00eb realizuar k\u00ebt\u00eb objektiv. N\u00eb disa punime t\u00eb miat t\u00eb m\u00ebhershme, e kam sjell\u00eb argumentin se kjo n\u00eb mas\u00eb t\u00eb madhe \u00ebsht\u00eb pasoj\u00eb e konteksteve dhe e perspektivave t\u00eb ndryshueshme, q\u00eb fitojn\u00eb pesh\u00eb m\u00eb t\u00eb madhe se sa vet faktet, t\u00eb cilat jan\u00eb t\u00eb nd\u00ebrtuara n\u00eb to. Megjith\u00ebk\u00ebt\u00eb, aty \u00ebsht\u00eb i pranish\u00ebm edhe nj\u00eb varg i t\u00ebr\u00eb i problemeve fundamentale, prej t\u00eb cilave shum\u00eb prej tyre burojn\u00eb nga parimi i thjesht se gjykatat nuk p\u00ebrgjigjen n\u00eb pyetjet, t\u00eb cilat nuk iu shtrohen.<\/p>\n<p>Si e para, asnj\u00eb proces gjyq\u00ebsor nuk \u00ebsht\u00eb n\u00eb gjendje si dhe as q\u00eb synon p\u00ebr t\u00eb prodhuar nj\u00eb regjist\u00ebr gjith\u00ebp\u00ebrfshir\u00ebs-faktik, p\u00ebrkat\u00ebsisht p\u00ebrshkrimin e plot\u00eb t\u00eb nj\u00eb ngjarjeve. Me gjith\u00eb th\u00ebnien e shpesht\u00eb se \u201ehistorin\u00eb e shkruajn\u00eb \u2026[t\u00eb futet termi i parap\u00eblqyer kolektiv \u2013 fitimtar\u00ebt? T\u00eb huajt?]\u201c \u2013 ajo \u00e7far\u00eb ndodh gjat\u00eb proceseve gjyq\u00ebsore gjithsesi se nuk \u00ebsht\u00eb shkrim i historis\u00eb. N\u00eb rastin m\u00eb t\u00eb mir\u00eb, ajo do t\u00eb mund t\u00eb p\u00ebrb\u00ebnte nj\u00eb revidim t\u00eb historis\u00eb. Nga numri i gjithmbarsh\u00ebm (dhe i madh) i kryer\u00ebsve, nj\u00eb p\u00ebrqindje e vog\u00ebl prej tyre n\u00eb fund do t\u00eb ndahen dhe do t\u00eb procedohen penalisht \u00a0\u2013 ndoshta vet\u00ebm pse di\u00e7ka n\u00eb veprimet e tyre ka karakter reprezentativ ose ngaq\u00eb kund\u00ebr tyre ka prova t\u00eb mjaftueshme, gj\u00eb q\u00eb i rrit gjasat p\u00ebr aktgjykimin faj\u00ebsues. Nga t\u00eb gjitha gj\u00ebrat, p\u00ebr t\u00eb cilat ata njer\u00ebz do t\u00eb mund t\u00eb p\u00ebrgjigjeshin, me akuza penale do t\u00eb p\u00ebrfshihen vet\u00ebm nj\u00eb pjes\u00eb e vog\u00ebl e tyre, q\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrgjithshme rrjedh nga qasja ndaj provave dhe kufizimet e qarta n\u00eb zbatimin e ligjit. P\u00ebr k\u00ebt\u00eb arsye, regjistri gjyq\u00ebsor n\u00eb m\u00ebnyr\u00eb t\u00eb pashmangshme e tregon vet\u00ebm nj\u00eb pjes\u00eb t\u00eb t\u00eb gjith\u00eb tregimit, madje edhe n\u00eb proceset, t\u00eb cilat synojn\u00eb t\u00eb jen\u00eb gjith\u00ebp\u00ebrfshir\u00ebse dhe p\u00ebr k\u00ebt\u00eb kan\u00eb mjete t\u00eb mjaftueshme. P\u00ebr arsye t\u00eb t\u00eb gjith\u00eb k\u00ebsaj, \u00ebsht\u00eb shum\u00eb m\u00eb e besueshme se materiali gjyq\u00ebsor n\u00eb m\u00ebnyr\u00eb shum\u00eb t\u00eb holl\u00ebsishme do t\u00eb p\u00ebrshkruaj vet\u00ebm disa pjes\u00eb t\u00eb caktuara, m\u00eb t\u00eb vogla t\u00eb tregimit \u2013 se sa q\u00eb do t\u2019ua ofroj nj\u00eb \u00e7far\u00ebdo pasqyre t\u00eb p\u00ebrgjithshme si dhe t\u00eb kuptuarit e gjer\u00eb t\u00eb saj.<\/p>\n<p>E dyta, jurist\u00ebt \u2013 pa marr\u00eb parasysh se a \u00ebsht\u00eb fjala p\u00ebr prokuror\u00ebt, mbrojt\u00ebsit apo gjyqtar\u00ebt \u2013 vetes i parashtrojn\u00eb objektiva tejet t\u00eb ngusht\u00eb. Ata q\u00ebllimin e tyre e kuptojn\u00eb si t\u00eb provuar, kund\u00ebrshtim ose vendim mbi nj\u00eb grumbull faktesh q\u00eb jan\u00eb n\u00eb lidhje me akuz\u00ebn konkrete penale, duke synuar q\u00eb gjat\u00eb rrjedh\u00ebs s\u00eb procesit t\u00eb sigurojn\u00eb drejt\u00ebsin\u00eb dhe respektimin e procedurave formale. Para s\u00eb gjithash, ata e kuptojn\u00eb gjykimin si proces, i cili i p\u00ebrfshin vet\u00ebm pal\u00ebt n\u00eb procedur\u00eb dhe shpesh jan\u00eb t\u00eb prir\u00eb drejt sugjerimeve se disa kategori t\u00eb gjera e deri diku edhe abstrakte, si\u00e7 jan\u00eb \u00a0\u201eviktimat\u201c ose \u00a0\u201eshoq\u00ebria\u201c \u2013 fare nuk jan\u00eb pjes\u00eb e asaj procedure dhe se, s\u00eb k\u00ebndejmi, nuk kan\u00eb interesa t\u00eb cilat \u00ebsht\u00eb e nevojshme t\u00eb p\u00ebrfaq\u00ebsohen n\u00eb gjykat\u00eb. K\u00ebshtu, jurist\u00ebt, e posa\u00e7\u00ebrisht prokuror\u00ebt, n\u00eb nj\u00eb periudh\u00eb t\u00eb caktuar shpesh e kan\u00eb shfryt\u00ebzuar gjuh\u00ebn e \u201epajtimit\u201c (me k\u00ebt\u00eb kryesisht jan\u00eb ndalur), por ai kurr\u00eb nuk \u00ebsht\u00eb kuptuar n\u00eb m\u00ebnyr\u00eb serioze, si q\u00ebllim p\u00ebrfundimtar i aktiviteteve t\u00eb tyre (gj\u00eb q\u00eb posa\u00e7\u00ebrisht vlen p\u00ebr jurist\u00ebt e angazhuar n\u00eb proceset penale).<\/p>\n<p>E treta, materialet, t\u00eb cilat i kan\u00eb l\u00ebn\u00eb pas vetes institucionet gjyq\u00ebsore \u2013 kurse k\u00ebt\u00eb, pas dy dhjet\u00ebvjet\u00ebshash, edhe vet kemi mundur p\u00ebr ta hetuar \u2013 p\u00ebrmbajn\u00eb gjurm\u00eb t\u00eb ndikimit t\u00eb disa faktor\u00ebve, t\u00eb cil\u00ebt nuk kan\u00eb shum\u00eb lidhje me k\u00ebrkimin e s\u00eb v\u00ebrtet\u00ebs. Kontradikta, e cila \u00ebsht\u00eb e pranishme n\u00eb gjyq\u00ebsorin ton\u00eb n\u00eb lidhje me disa \u00e7\u00ebshtje t\u00eb caktuara, sikurse anonimizimi i aktakuzave dhe i koh\u00ebzgjatjeve t\u00eb aktgjykimeve t\u00eb shqiptuara \u2013 pik\u00ebrisht flet p\u00ebr zbraz\u00ebtit\u00eb dhe paqart\u00ebsit\u00eb serioze ligjore, por edhe p\u00ebr munges\u00ebn e konsensusit mbi vet q\u00ebllimin e proceseve gjyq\u00ebsore. N\u00eb nj\u00eb faz\u00eb t\u00eb m\u00ebvonshme t\u00eb pun\u00ebs, edhe TNPJ \u00ebsht\u00eb shfryt\u00ebzuar si laborator p\u00ebr testimin e teorive t\u00eb reja juridike dhe kjo, n\u00eb disa instanca, e ka n\u00ebnkuptuar injorimin e plot\u00eb t\u00eb provave t\u00eb paraqitura. Efektet e k\u00ebsaj, jo vet\u00ebm q\u00eb e kan\u00eb thelluar kontradikt\u00ebn, e cila i ka p\u00ebrcjell\u00eb disa vendime t\u00eb gjykat\u00ebs (si\u00e7 \u00ebsht\u00eb aktgjykimi n\u00eb l\u00ebnd\u00ebt <em>Stuhia, Perishiqi <\/em>dhe <em>Stanishiqi, <\/em>p\u00ebr t\u00eb cilat Cristopher Jenks e ka shkruar nj\u00eb analiz\u00eb t\u00eb shk\u00eblqyeshme, <a href=\"http:\/\/www.jstor.org\/stable\/10.5305\/amerjintelaw.107.3.0622\">http:\/\/www.jstor.org\/stable\/10.5305\/amerjintelaw.107.3.0622<\/a>), por kan\u00eb shkaktuar edhe konflikt me vet Tribunalin, n\u00eb t\u00eb cilin gjyqtar\u00ebt jan\u00eb sjell\u00eb thuajse i zgjedhin pal\u00ebt. Nj\u00eb nga efektet ka qen\u00eb edhe minimi i statusit t\u00eb aktgjykimeve gjyq\u00ebsore si narrativ\u00eb p\u00ebrfundimtar mbi disa ngjarje; ato sot, n\u00eb t\u00eb v\u00ebrtet\u00eb, m\u00eb shum\u00eb i p\u00ebrngjajn\u00eb intervenimeve n\u00eb konteste, se sa n\u00eb zgjidhjen e tyre. Krahas k\u00ebsaj, n\u00eb fund do t\u00eb mund t\u00eb pandehej se vet aktgjykimet, n\u00eb t\u00eb v\u00ebrtet\u00eb, edhe nuk jan\u00eb pjesa m\u00eb e r\u00ebnd\u00ebsishme ose m\u00eb e \u00e7muar e gjith\u00eb atij materiali, i cili n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb p\u00ebrb\u00ebn\u00eb edhe trash\u00ebgimin\u00eb e gjithmbarshme t\u00eb Tribunalit, p\u00ebrkat\u00ebsisht t\u00eb proceseve gjyq\u00ebsore, t\u00eb cilat jan\u00eb zhvilluar para tij.<\/p>\n<p>Megjith\u00ebk\u00ebt\u00eb, e, ndoshta, kjo edhe m\u00eb e r\u00ebnd\u00ebsishmja \u2013 nj\u00eb pjes\u00eb e dijeve, q\u00eb m\u00eb s\u00eb shumti do t\u00eb duhej t\u2019i kontribuonte pajtimit, \u00ebsht\u00eb e bazuar n\u00eb fakte t\u00eb cilat me gjas\u00eb kurr\u00eb nuk do t\u00eb p\u00ebrfshihen me an\u00eb t\u00eb ndonj\u00eb aktakuze. Kjo i p\u00ebrfshin faktet, t\u00eb cilat ende nuk jan\u00eb t\u00eb njohura, sepse asnj\u00ebher\u00eb nuk jan\u00eb hetuar plot\u00ebsisht (si\u00e7 jan\u00eb t\u00eb dh\u00ebnat e besueshme mbi numrin e t\u00ebr\u00ebsish\u00ebm t\u00eb viktimave dhe t\u00eb t\u00eb zhdukurve n\u00eb konfliktet e ve\u00e7anta), por edhe faktet p\u00ebr t\u00eb cilat nuk ekziston konsensusi, si\u00e7 \u00ebsht\u00eb periudha e zgjatjes s\u00eb konflikteve. Krahas k\u00ebsaj, ekzistojn\u00eb edhe disa fakte t\u00eb caktuara, t\u00eb cilat \u00ebsht\u00eb e domosdoshme t\u00eb qart\u00ebsohen, edhe pse ato nuk i p\u00ebrfshijn\u00eb veprat penale, si\u00e7 \u00ebsht\u00eb roli i institucioneve shoq\u00ebrore (mediat, kisha etj.) n\u00eb nxitjen e dhun\u00ebs.
