Kur flasim p\u00ebr politikat e s\u00eb kaluar\u00ebs dhe politikat e historis\u00eb, i referohemi politikave publike specifike, t\u00eb cilat qeverit\u00eb e vendeve t\u00eb ndryshme i marrin n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb sh\u00ebnojn\u00eb ndonj\u00eb ngjarje nga e kaluara, q\u00eb ta bartin kujtimin dhe p\u00ebrvoj\u00ebn institucionale dhe kolektive dhe ta fuzionojn\u00eb n\u00eb ndonj\u00eb segment t\u00eb edukimit publik dhe t\u00eb kultur\u00ebs ose q\u00eb, prap\u00eb, ta p\u00ebrfshijn\u00eb n\u00eb nj\u00eb protokoll shtet\u00ebror, i cili shpesh posedon edhe elemente t\u00eb ritualit shtet\u00ebror, p\u00ebrkat\u00ebsisht t\u00eb t\u00eb ashtuquajturit \u201dreligjion civil\u201c. N\u00eb an\u00ebn tjet\u00ebr, megjith\u00ebk\u00ebt\u00eb, ekziston kultura e p\u00ebrkujtimit \u2013 kultura t\u00eb ndryshme t\u00eb praktik\u00ebs s\u00eb p\u00ebrkujtimit t\u00eb s\u00eb kaluar\u00ebs s\u00eb af\u00ebrt e t\u00eb larg\u00ebt, t\u00eb cilat munden, por edhe nuk \u00ebsht\u00eb e th\u00ebn\u00eb q\u00eb t\u00eb ken\u00eb karakter t\u00eb institucionalizuar. Me fjal\u00eb t\u00eb tjera, ato, sipas rregull\u00ebs, kan\u00eb nj\u00eb m\u00ebnyr\u00eb shum\u00eb m\u00eb spontane, organike t\u00eb krijimit dhe t\u00eb funksionimit. P\u00ebrkujtimi gjithmon\u00eb \u00ebsht\u00eb m\u00eb intim, m\u00eb personal dhe m\u00eb emotiv, derisa historia \u00ebsht\u00eb e lidhur me institucionet shtet\u00ebrore dhe narrativat kolektiv, t\u00eb cil\u00ebt pashmangshm\u00ebrisht jan\u00eb t\u00eb shk\u00ebputur nga jeta e p\u00ebrditshme dhe jan\u00eb t\u00eb abstraktuara nga niveli i p\u00ebrvoj\u00ebs individuale njer\u00ebzore.<\/p>\n<p>Pra, gjat\u00eb dallimit t\u00eb nivelit institucional dhe personal, p\u00ebrkat\u00ebsisht nivelit shoq\u00ebror t\u00eb ballafaqimit me t\u00eb kaluar\u00ebn, p\u00ebrkat\u00ebsisht t\u00eb p\u00ebrpunimit t\u00eb saj (gjermanisht <em>Aufarbeitung<\/em>), \u00ebsht\u00eb e nevojshme q\u00eb t\u00eb jemi t\u00eb nd\u00ebrgjegjsh\u00ebm p\u00ebr nivelet e ndryshme t\u00eb konceptimit t\u00eb s\u00eb kaluar\u00ebs. Historiani francez, Pierre Nora qartazi e ndan kujtimin (greqisht <em>memoria<\/em>) n\u00eb nivelin personal dhe historin\u00eb (greqisht <em>historia<\/em>) n\u00eb rrafshin shtet\u00ebror. Kujtimi \u00ebsht\u00eb i hapur, i gjall\u00eb, intim. Historia, megjith\u00ebk\u00ebt\u00eb, \u00ebsht\u00eb e abstraktuar, e depersonalizuar, e institucionalizuar dhe e kodifikuar.<\/p>\n<p>N\u00eb fund arrijm\u00eb deri te \u00e7\u00ebshtja e pajtimit, si t\u00eb atij individual, ashtu edhe t\u00eb atij kolektiv, por edhe deri te \u00e7\u00ebshtja e drejt\u00ebsis\u00eb tranzicionale, p\u00ebrkat\u00ebsisht tek menaxhimi post-konfliktual i proceseve gjyq\u00ebsore t\u00eb hetimeve dhe te sanksionimi i krimeve t\u00eb luft\u00ebs dhe t\u00eb pasluft\u00ebs si dhe shkelja e t\u00eb drejt\u00ebs s\u00eb luft\u00ebs dhe e ligjeve t\u00eb luft\u00ebs.<\/p>\n<p>P\u00ebrvojat personale pashmangsh\u00ebm jan\u00eb heterogjene dhe kontradiktore. Puna e shoqatave, t\u00eb p\u00ebrfshira n\u00eb nism\u00ebn p\u00ebr KOMRA, me njer\u00ebzit e terrenit do t\u00eb duhej t\u00eb vler\u00ebsonin p\u00ebrvojat e tilla, pik\u00ebrisht p\u00ebr faktin se jan\u00eb personale dhe ngaq\u00eb sjellin nj\u00eb v\u00ebshtrim n\u00eb repekursionet e luft\u00ebs n\u00eb p\u00ebrditshm\u00ebrin\u00eb njer\u00ebzore, porse ato nuk kan\u00eb karakter p\u00ebrgjith\u00ebsues. Edhe pse t\u00eb kund\u00ebrta, k\u00ebto kujtime t\u00eb njer\u00ebzve t\u00eb ndrysh\u00ebm mund t\u00eb ndihmojn\u00eb n\u00eb tejkalimin individual t\u00eb s\u00eb kaluar\u00ebs dhe kthimin nga e ardhmja. Megjith\u00ebk\u00ebt\u00eb, fokusimi i tep\u00ebrt n\u00eb raundet e takimeve dhe t\u00eb d\u00ebshmive t\u00eb kryer\u00ebsve t\u00eb krimeve dhe t\u00eb viktimave, t\u00eb krijuara sipas modelit t\u00eb Komisionit jug-afrikan t\u00eb s\u00eb v\u00ebrtet\u00ebs dhe t\u00eb pajtimit (<em>Truth and Reconciliation Commission<\/em>), nga pak e mjegullon realitetin dhe nuk krijon baza mjaft t\u00eb mira p\u00ebr t\u00eb ardhmen. P\u00ebrndryshe, d\u00ebshmit\u00eb e viktimave, para s\u00eb gjith\u00eb t\u00eb atyre civile, posa\u00e7\u00ebrisht jan\u00eb esenciale n\u00eb m\u00ebnyr\u00eb q\u00eb krimi t\u00eb mos harrohet. Megjith\u00ebk\u00ebt\u00eb, ndri\u00e7imi nuk \u00ebsht\u00eb i mjaftuesh\u00ebm. K\u00ebnaq\u00ebsia e nj\u00ebmend\u00ebt dhe sh\u00ebrimi i plag\u00ebve jan\u00eb t\u00eb mundshme vet\u00ebm n\u00ebse d\u00ebshmit\u00eb e mbledhura, provat dhe dokumentacioni p\u00ebrcjell\u00ebs t\u00eb ken\u00eb rezultuar me hetime policore dhe procese gjyq\u00ebsore. Q\u00ebllim p\u00ebrfundimtar i KOMRA-s nuk do t\u00eb duhej t\u00eb ishin vet\u00ebm pajtimi dhe normalizimi i marr\u00ebdh\u00ebnieve midis shteteve post-jugosllave (normalizimi q\u00eb moti \u00ebsht\u00eb arritur), por edhe d\u00ebrgimi i dy mesazheve t\u00eb r\u00ebnd\u00ebsishme, gjith\u00ebnjer\u00ebzore. Porosia e par\u00eb \u00ebsht\u00eb \u2013 krimi nuk paguhet dhe secili krim i fshehur, her\u00ebt ose von\u00eb, do t\u00eb dal n\u00eb shesh. Porosia e dyt\u00eb \u00ebsht\u00eb \u2013 lufta \u00ebsht\u00eb shoq\u00ebrisht e pad\u00ebshirueshme, duke qen\u00eb se n\u00eb luft\u00eb t\u00eb gjith\u00eb vuajn\u00eb dhe pakkush mbetet i paprekur, n\u00eb k\u00ebt\u00eb ose n\u00eb at\u00eb m\u00ebnyr\u00eb.<\/p>\n<p>Respekti p\u00ebr p\u00ebrvojat individuale, tregimet personale, historit\u00eb personale t\u00eb cilat jan\u00eb n\u00eb shp\u00ebrputhje me historiografin\u00eb zyrtare dhe pranimin e vuajtjes njer\u00ebzore dhe t\u00eb p\u00ebsimeve n\u00eb radh\u00ebt e t\u00eb gjitha ushtrive dhe komunitetet e popullat\u00ebs civile nuk jan\u00eb dhe nuk mund t\u00eb jen\u00eb thirrje p\u00ebr rip\u00ebrkufizimin e roleve historike t\u00eb agresor\u00ebve dhe mbrojt\u00ebsve, ushtris\u00eb sulmuese dhe asaj mbrojt\u00ebse. P\u00ebsimet e luft\u00ebs jan\u00eb universale, por lidhjet shkak-pasoj\u00eb qart\u00ebsisht t\u00eb v\u00ebrtetuara dhe kronologjia e ngjarjeve flasin p\u00ebr pal\u00ebt fitimtare dhe humb\u00ebse, p\u00ebr fajtor\u00eb dhe t\u00eb pafajsh\u00ebm. Fshirja ose zvog\u00eblimi i k\u00ebtyre dallimeve n\u00eb mas\u00eb t\u00eb madhe do t\u00eb groposnin p\u00ebrpjekjet n\u00eb tejkalimin e pasojave t\u00eb luft\u00ebs dhe, s\u00eb k\u00ebndejmi, nuk do t\u00eb ishte zotim p\u00ebr pajtim, por p\u00ebr rob\u00ebrimin n\u00eb t\u00eb kaluar\u00ebn e luft\u00ebs.<\/p>\n<p>Mbi afrimin e q\u00ebndrimeve mund t\u00eb flasim n\u00eb nivel t\u00eb debatit akademik, por v\u00ebshtir\u00eb mund ta presim n\u00eb rrafshin politik ose, sidoqoft\u00eb, n\u00eb rrafshin e vet qytetar\u00ebve \u2013 pjes\u00ebmarr\u00ebsve t\u00eb luft\u00ebs dhe viktimave t\u00eb luft\u00ebs civile. Madje edhe brenda kontekstit akademik, \u00ebsht\u00eb e v\u00ebshtir\u00eb q\u00eb pik\u00ebpamjet e shum\u00ebfishta t\u00eb reduktohen n\u00eb nj\u00eb em\u00ebrues t\u00eb p\u00ebrbashk\u00ebt, e t\u00eb mos flitet jasht\u00eb k\u00ebtij konteksti, jasht\u00eb t\u00eb cilit niveli i toleranc\u00ebs ndaj pik\u00ebpamjeve dhe perspektivave thell\u00ebsisht t\u00eb ndryshme \u00ebsht\u00eb shum\u00eb m\u00eb i ul\u00ebt. Gjat\u00eb viteve t\u00eb fundit, bashk\u00ebsia akademike nd\u00ebrkomb\u00ebtare ka arritur nj\u00eb nivel t\u00eb caktuar t\u00eb konsensusit mbi kronologjin\u00eb dhe marr\u00ebdh\u00ebniet kauzale t\u00eb luft\u00ebrave n\u00eb hap\u00ebsir\u00ebn e ish Jugosllavis\u00eb. Megjith\u00ebk\u00ebt\u00eb, pik\u00ebpamjet e es\u00ebllta dhe t\u00eb balancuara, deri tek t\u00eb cilat kan\u00eb arritur koleg\u00ebt n\u00eb institucionet udh\u00ebheq\u00ebse bot\u00ebrore t\u00eb dijes, ende nuk kan\u00eb hasur n\u00eb jehon\u00eb n\u00eb katedrat e universiteteve post-jugosllave. P\u00ebr p\u00ebrparimin e debatit akademik mbi t\u00eb kaluar\u00ebn e luft\u00ebs dhe tejkalimin e s\u00eb kaluar\u00ebs, s\u00eb k\u00ebndejmi, \u00ebsht\u00eb e nevojshme nj\u00eb vet-reflektim kritik brenda bashk\u00ebsive t\u00eb ve\u00e7anta komb\u00ebtare akademike.<\/p>\n<p>Nga arsyet e cekura m\u00eb lart\u00eb, shkrimi i p\u00ebrbashk\u00ebt i nj\u00eb historie zyrtare nga fitimtar\u00ebt dhe humb\u00ebsit nuk \u00ebsht\u00eb dhe nuk mund t\u00eb jet\u00eb i realizuesh\u00ebm. S\u00eb k\u00ebndejmi, ideja mbi tekstet shkollore t\u00eb p\u00ebrbashk\u00ebta ose t\u00eb harmonizuara t\u00eb historis\u00eb bashk\u00ebkohore \u00ebsht\u00eb plot\u00ebsisht iluzore dhe, s\u00eb k\u00ebndejmi, nuk i kontribuon pajtimit.<\/p>\n<p>Pra, \u00e7ka \u00ebsht\u00eb e nevojshme p\u00ebr nd\u00ebrtimin e pajtimit n\u00eb nivel institucional? Para s\u00eb gjithash, \u00ebsht\u00eb e nevojshme t\u00eb hapen arkivat n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb mund\u00ebsohej bashk\u00ebpunimi i nj\u00ebmend\u00ebt i mjekoligjor\u00ebve, antropolog\u00ebve, historian\u00ebve dhe politolog\u00ebve nga vendet trash\u00ebgimtare t\u00eb RSFJ-s\u00eb. Pa v\u00ebrtetimin e fakteve dhe pa institucione t\u00eb koordinuara mir\u00eb, t\u00eb cilat do ta grumbullojn\u00eb materien, nuk \u00ebsht\u00eb i mundur kurrfar\u00eb p\u00ebrparimi n\u00eb procesin e d\u00ebnimit t\u00eb krimit, t\u00eb pajtimit dhe t\u00eb nd\u00ebrtimit t\u00eb paqes.<\/p>\n<p>Me an\u00eb t\u00eb konstatimit t\u00eb gjendjes faktike (numri i viktimave, urdh\u00ebrdh\u00ebn\u00ebsit, kryer\u00ebsit e krimeve, vendi i kryerjes s\u00eb krimeve) mundet dhe duhet t\u00eb ndalet manipulimi me viktimat dhe tenderi me numrat e viktimave, q\u00eb n\u00eb kontekste t\u00eb ndryshme shfryt\u00ebzohen si arm\u00eb t\u00eb legjitimitetit politik \u2013 statusi i viktim\u00ebs shfryt\u00ebzohet p\u00ebr arsyetimin e veprimit politik, qoft\u00eb n\u00eb luft\u00eb, qoft\u00eb pas saj. Pas v\u00ebrtetimit t\u00eb vendit t\u00eb krimeve t\u00eb kryera, t\u00eb gjitha viktimat dhe familjet e tyre duhet t\u00eb ken\u00eb rastin p\u00ebr t\u00eb sh\u00ebnuar varret e m\u00eb t\u00eb af\u00ebrmve t\u00eb tyre n\u00eb m\u00ebnyr\u00eb t\u00eb dinjitetshme. Duke qen\u00eb se \u00e7\u00ebshtja e pajtimit dhe e tejkalimit t\u00eb s\u00eb kaluar\u00ebs n\u00eb vendet e ish Jugosllavis\u00eb nuk i p\u00ebrfshin vet\u00ebm ngjarjet e luft\u00ebs pas vitit 1990, por shpesh p\u00ebrfshin edhe referimin e kryer\u00ebsve t\u00eb krimeve dhe viktimat n\u00eb periudha m\u00eb t\u00eb hershme historike, n\u00eb koordinimin e hulumtuesve dhe t\u00eb regjistruesve t\u00eb informatave relevante \u00ebsht\u00eb thelb\u00ebsore t\u00eb p\u00ebrfshihet edhe materiali arkivor nga periudhat e m\u00ebhershme historike (Lufta e Dyt\u00eb Bot\u00ebrore, periudha e RSFJ-s\u00eb, dokumentacioni i posa\u00e7\u00ebm i sh\u00ebrbimeve informative). \u00cbsht\u00eb i nevojsh\u00ebm vullneti politik i pushtetit ekzekutiv, n\u00eb duart e t\u00eb cilit ndodhet shumica e atij dokumentacioni p\u00ebr bashk\u00ebpunim dhe p\u00ebr ndarjen e atyre informacioneve me pal\u00ebt e tjera t\u00eb interesuara, p\u00ebrkat\u00ebsisht viktimat.<\/p>\n<p>Kur flasim p\u00ebr pajtimin n\u00eb hap\u00ebsir\u00ebn e ish Jugosllavis\u00eb, shpesh hasim n\u00eb besim t\u00eb ul\u00ebt t\u00eb qytetar\u00ebve n\u00eb institucionet e gjyq\u00ebsorit dhe n\u00eb ato p\u00ebrfaq\u00ebsimtare (parlamenti). KOMRA do t\u00eb duhej t\u00eb ishte mb\u00ebshtetje p\u00ebr kanalet zyrtare institucionale, e kurrsesi nj\u00eb z\u00ebvend\u00ebsim i tyre. Do t\u00eb ishte e d\u00ebmshme sikur publiku ta fitonte p\u00ebrshtypjen se \u00ebsht\u00eb fjala p\u00ebr nj\u00eb organ, i cili do t\u00eb duhej t\u00eb z\u00ebvend\u00ebsonte ose t\u00eb ndryshonte rezultatet e gjykimit brenda ICTY-s\u00eb (TNKJ) dhe gjykatave komb\u00ebtare, t\u00eb cilave iu jan\u00eb deleguar proceset gjyq\u00ebsore t\u00eb p\u00ebrfshira me mandatin e Gjykat\u00ebs n\u00eb Den Haag (Hag\u00eb).<\/p>\n<p>Personalisht e shoh KOMRA-n si nj\u00eb p\u00ebrplot\u00ebsim specifik dhe si mb\u00ebshtetje p\u00ebr proceset e gjyq\u00ebsorit n\u00eb rrafsh komb\u00ebtar dhe nd\u00ebrkomb\u00ebtar, si nj\u00eb korrektiv i cili do t\u00eb mbledh informatat dhe i cili do t\u00eb ushtroj trysni n\u00eb organet policore dhe gjyq\u00ebsore q\u00eb t\u00eb hulumtojn\u00eb krimet e heshtura, t\u00eb ndalojn\u00eb personat e dyshuar p\u00ebr kryerje t\u00eb atyre krimeve dhe q\u00eb t\u00eb ofrojn\u00eb kompensim p\u00ebr viktimat e tyre.<\/p>\n<p>&nbsp;<\/p>\n<p><em>\u00a0sc.
